International Cooperation

9.1. Cooperation with the World Intellectual Property Organization (WIPO)

The main purpose of the Rospatent – WIPO cooperation consists in further integration of the national system for intellectual property protection of Russia to the world process for harmonizing corresponding national systems under the auspices of the WIPO. During the year under review, Rospatent took an active part in the activities of the WIPO main Committees and Working groups.

The following documents were drafted and submitted to WIPO within the framework of this activities:

  • comments and proposals related to the draft of the WIPO Program and Budget for the biennium 2002-2003;
  • materials to WIPO document concerning the protection of trademarks and other signs on the Internet considered during the 6th session of the Standing Committee on the Law of Trademarks, Industrial Designs and Geographical indications;
  • proposals and comments to the session of the Working group on Reform of WIPO;
  • comments to three drafts of reforming the activities of the Standing Committee on Information Technologies (SCIT);
  • materials to the 30th session of the IPC Committee of Experts on Revision of the International Patent Classification.

From 24 September to 4 October, 2001, the 36th series of the Assemblies of the Member States of WIPO (the WIPO Governing Bodies) was held in Geneva.

More than 20 significant items were discussed during the sessions of the WIPO Governing Bodies with an active participation of the Russian delegation. The most important issues are: adoption of the results of implementation of the WIPO Program and Budget for 2000-2001, approval of the WIPO Program and Budget for 2002-2003, approval of proposals dealing with organizational and legal reformation of WIPO, reform of the PCT, etc.

The regular meeting of the WIPO Policy Advisory Commission, which took place from October 10 to 12,2001, considered two main issues: development of international patent system; interrelation between intellectual property and genetic resources, traditional knowledge and folklore. A.D. Korchagin, Director General of Rospatent was invited to participate in the said meeting.

In 2001 an active work for implementation of the Program of Cooperation between the Russian Federation and WIPO was continued.

From May 23 to 25, 2001 Mr. Mpazi Sinjela, Director, WIPO Worldwide Academy (WWA) visited Rospatent within the framework of the said Program. The purpose of the visit consisted in establishment of working links and discussing the problems of using the WWA potential for training specialists of the Russian Federation in the field of intellectual property.

Among numerous directions of the WWA’ activity there is a specific kind of learning — the distance learning courses. At present distance learning is offered in English, French, Spanish and Chinese.

The Framework Agreement on Cooperation between Rospatent and WIPO was signed in Geneva on October 12, 2001 which is aimed at the development of cooperation in the sphere of training specialists of the Russian Federation in the field of intellectual property, in particular, implementation of the joint project on distance learning according the program of the WWA in Russian on the basis of the Rospatent facilities.

In 2001 two regional seminars were organized and held jointly by WIPO and Rospatent within the framework of the Program of Cooperation:

  • «Seminar on Copyright and Related Rights in Information Age» for certain countries of Europe and Asia;
  • «Regional Seminar on Intellectual Property and Information Technology» for the East European, CIS countries and Russia.

The concrete proposals for realization of the Rospatent-WIPO Program of Cooperation for 2002-2003 were submitted to WIPO.

In November 2001 the representative of Rospatent attended the Symposium on the International Protection of Geographical Indications (Montevideo, Uruguay) held by WIPO in cooperation with the National Directorate of Industrial Property of Uruguay. To promote the application of international agreements in this country, the relevant proposals on conditions of joint three-language publication of the 8th edition of the Nice Classification were submitted to WIPO.

9.2. International Agreements of Russia

In 2001 Rospatent jointly with other interested offices took part in works aimed at bringing into compliance the draft intergovernmental agreements worked out by the Russian Ministry of Science, Russian Space Agency and Ministry of Foreign Affairs (draft agreements with Malaysia, Republic of Korea, China, Spain, India, Syria), including cooperation in the study and use of outer space for peaceful purposes (draft agreements with Australia, European Space Agency, Chili, Germany, Italy, Republic of Korea and Rumania).

Within the framework of participation of Russia in the Forum of the Asian and Pacific Economic Cooperation (APEC), Rospatent has prepared proposals to the Section «Intellectual Property Rights» under an Individual Plan of Actions on the liberalization of trade and investments.

The Rospatent delegation took an active part in the APEC International Symposium on Intellectual Property and Information Technology (November 2001, Republic of Korea), which was welcomed by Dr. Kamil Idris, Director General, WIPO during the opening ceremony.

9.3. Cooperation with the European Union (EU)

In 2001 the activity in drafting the joint Russia-EU Plan of Actions in the field of intellectual property, aimed at the implementation of the Russia–EU Partnership and Cooperation Agreement, was continued.

The consultative meetings with the participation of the interested Ministries and Offices were held in which the participants came to agreement to draft a joint Plan of Actions for the period 2001-2002 and the basic issues thereof were discussed.

A new draft Plan was considered during the 4th meeting of the Sub-committee on Competition, IPR, Approximation of Legislation Fight Against Crime of the Russia-EU Committee on Cooperation (November 20 to 21, 2001, Brussels) , where the representatives of Rospatent took part.

9.4. Russia — WTO Cooperation

Within the framework of multilateral negotiations the Russian delegation, including the Rospatent representative, took part in the regular (twelve) session of the Working Group on the accession of Russia to the WTO. The Rospatent has prepared the replies to both questions and comments of the Working Group’ Member States. The analytical materials to the text of «Review of the Russian Trade Policy», submitted to the WTO Secretariat , were updated as well.

9.5. Cooperation with the European Patent Office (EPO)

In 2001 the cooperation between the Rospatent and the EPO in the field of information exchange, professional training of personnel and using of new information technology was developed constantly.

To execute agreements concluded earlier with the EPO, works were in progress to scan the backlog of the Russian patent documents using equipment and technology provided by the EPO.

At the end of May — at the beginning of June 2001, Dr.h.c. Ingo Kober, the President of the European Patent Office paid a visit to Rospatent. In the course of visit the Rospatent-EPO talks were conducted with the participation of representatives of the Administration of the Russian Federation Government. During this negotiations the delegations discussed the results of joint activities of the Offices as well as the ways of further cooperation aimed at achievement of unified approach to using information technologies and networks, creation of favorable conditions for information support of the users, rendering the EPO assistance in training the Rospatent personnel. As a result of negotiations, the Agreed Protocol on technical cooperation was signed.

On June 4 to 5, 2001, an International Seminar «Biotechnology and Patents» was held in cooperation with the EPO. The Seminar was attended by over 100 representatives of the CIS countries, Mongolia and Russian regions, businessmen and patent attorneys’ companies.

As far as training and improvement of professional skills of Rospatent staff is concerned, the specialists of Rospatent participated with the financial support of the EPO in a Seminar «Search in CD-ROM, Internet and Databases» (March, 2001, Vienna, Austria) and «EPO Appellation Procedures» (November, Vienna, Austria).

With the assistance of Rospatent, five representatives of the Moscow Court of Arbitration attended the Seminar «Patent Litigation» organized by the EPO Academy (September 10 to 14, 2001, Munich).

9.6. Bilateral Relations

On February 2001 a regular meeting of the Russian-American Working Group on Intellectual property, established according to the bilateral Agreement on Trade Relations (1990) was held in the USA. The Russian delegation headed by A.D.Korchagin, Director General, Rospatent consisted of the representatives of Ministry of Justice, Ministry of Interiors, Moscow Court of Arbitration, Ministry of Culture, Ministry of Economical Development engaged in resolving problems related to intellectual property. The Working Group in this meeting discussed the proposals of the Russian Federation Government concerning development of the Russian legislation in the field of intellectual property, law enforcement practice in Russia related to intellectual property rights , legal protection of well-known marks and undisclosed information, the WIPO copyright treaties. The parties came to agreement that coordination of activities in the field of intellectual property and further contacts among the members of the Working Group will be carried out through the Rospatent representative (from the Russian side) and officer of the US Trade Representative Office (from American side). The American party expressed readiness to render technical assistance to Russia, in particular, by organization of seminars for judges, law enforcement and customs’ officers. As a result of the said agreement, a seminar on repression of infringements in the field of intellectual property, financed by American party, was held in Washington, D.C. (December, 2001). The Rospatent played the role of the Coordinator and Co-organizer. 15 representatives from 8 Ministries and Offices of the Russian Federation attended this seminar.

In September 2001 the 4th session of the Mixed Russian-French Working Group on Industrial Property, co-headed by the Director General of Rospatent and Director General of the National Institute of Industrial Property of France, was held in Rospatent premises. In the course of the meeting the parties exchanged by information concerning the national legislation in the field of industrial property, discussed the results of joint activities for 1998-2000 as well as outlined the perspectives of future joint activities. In result of the session a Protocol was signed.

In December 2001 the Rospatent delegation, headed by the Director General, visited the Office for Harmonization in the Internal Market (OHIM) of the European Union (Spain, Alicante) with a view to establish and develop the cooperation between two Offices, exchange of experience and harmonization of legal provisions and methodical approaches to estimation of trademarks protectability. The parties exchanged by proposals dealing with organization of a joint seminar, mutual probation of the Rospatent and OHIM’ examiners, as well as exchange of information related to the registered trademarks in machine-readable carriers.

To execute the Working Plan of Cooperation between Rospatent and Hungarian Patent Office, singed in 2001, specialists of Rospatent and Hungarian Patent Office have held a meeting aimed at the exchange of experience. The Russian delegation got acquaintance with the current legislative basis of Hungary in the field of industrial property, activities of Hungarian Patent Office in the field of examination control, development of information technology, rendering services to the users of information, training of personal, etc. The Parties agreed upon to continue a practice of such meetings among the Offices’ specialists.

The Rospatent delegation, on the invitation of Tadjikistan party paid a visit to the National Center for Patents and Information of the Republic of Tadjikistan. The result of the negotiation was drafting and signing at the end of 2001 an Agreement on Cooperation in the Field of Industrial Property Protection between Rospatent and National Center for Patents and Information of the Republic of Tadjikistan. In 2001, at the request of the Ukrainian Institute of Industrial Property, the working meetings were held between specialists of two Offices on exchange of experience in the field of examination procedure, computerization of patent applications processing, information for joint CD-ROM of the CIS countries, publication of official information. In the course of the first meeting an Agreement on Patent Information Exchange was signed.

In March 2001 an Agreement on Cooperation in the field of examination of patent applications between the Federal Institute of Industrial Property, Rospatent and State Intellectual Property Office of the Republic of Croatia was signed in Moscow. Within the framework of the Protocol on Intentions for Cooperation signed in the summer of 2001 between Rospatent and National Office of Industrial Property of Viet Nam, Rospatent submitted the proposals regarding to training the specialists of Viet Nam.

With a view to improve an international exchange of patent information the Agreements on patent information exchange were drafted and signed with the patent offices of the following countries: Bulgaria, Hungary, Lithuania, Netherlands, Poland, Rumania, Croatia, Ukraine and Estonia. Moreover, drafts of new Agreements on patent information exchange were submitted to the patent offices of the following countries: the USA, Germany (Protocol), China, Republic of Korea, Latvia, Slovenia, Slovakia and the British Library. The proposals to conclude an Agreement between the FIPS and National Intellectual Property Office of Georgia (Sakpatenti) on search and examination as well as to revise a similar Agreement with the Institute of Patent Examination of Kazakhstan were submitted. The cooperation between Rospatent and information firm «Derwent» (Great Britain) has developed: a new Agreement on delivery and licensing between the Federal Institute of Industrial Property, Rospatent and «Derwent» was signed; delegation of Rospatent was invited to attend the European jubilee conference dedicated to the 50th anniversary of the establishment of firm «Derwent».

9.7. Cooperation with CIS Countries

The Rospatent actively participates in work of the Intergovernmental Council on Industrial Property Protection (IGC).

28 March, 2001 (Kischinev, Moldova) a meeting of the heads of the patent offices of the IGC Member States and Executive Committee of the Coalition for Intellectual Property Rights (CIPR) was held to discuss the role and plans of activities of the CIPR in the CIS countries.

From May 22 to 23, 2001 the ordinary session of the IGC took pace, in result of which, the proposals on development of the Council activities were adopted.

In the course of the session the following problems were discussed with an active participation of the Russian delegation:

  • on protection of industrial property in the IGC Member States;
  • proposals on promotion of inventive activities in the IGC Member States (adopted materials were submitted to the Executive Committee of the CIS countries);
  • on signing the Agreement on the production of joint CIS regional patent information product on CD-ROM (during the session the Agreement and Protocol were signed by Plenipotentiary Representatives of Belarus, Moldova, Tadjikistan and the President of the EAPO as well);
  • on the IGC reform (new IGC Regulations was approved);
  • on interrelations with the Executive Committee of the CIS countries (IGC Secretariat was obliged to draft and co-ordinate an Agreement on Strengthening of the Council Role).

Within the framework of the works aimed at implementation of decisions of the Interstate Council on Industrial Property Protection, the proposals on the Council reform and draft Recommendations on the Measures for Promotion of Inventive and Innovative Activities were submitted to the IGC Chairman.

With a view of realization of the project on production of joint CIS regional CD-ROM in 2001, 8 IGC Member States signed the Agreement on the production of joint CIS regional patent information product on CD-ROM in result of which the said Agreement came into force.

The Coordination Committee of the project on the production of joint CIS regional patent information product on CD-ROM discussed in the meeting held in October 20 to 21, 2001 the problems related to the beginning of mass production of CD-CIS.

The economic, organizational, technical and technological aspects of mutual relations among the patent offices of the CIS Member States concerning the production of CD-CIS were under discussion during this meeting.

The Rospatent in cooperation with the Federal Institute of Industrial Property (FIPS) showed an exposition «IGC and EAPO», as well as IPR-Helpdesk in the Interstate Exhibition, dedicated to the 10th anniversary of the CIS, which took place in Moscow (December 10 to 14, 2001).

9.8. Cooperation With the Eurasian Patent Organization

The Eleven (8th regular) Session of the EAPO Administrative Council (AC EAPO) was held from October 15 to19, 2001.

The Plenipotentiary Representatives of the Russian Federation, Belarus, Azerbaijan, Kyrgyzstan, Armenia and the Deputy Plenipotentiary Representatives of Tadjikistan and Moldova, as well as representative of the WIPO, participated in the meeting of the AC EAPO.

Within the framework of the preparation to the AC EAPO meeting, Rospatent delegation took part in the regular session of the Working Group of Experts of the Eurasian Patent Convention (EAPC) Member States on Amendments to Patent Regulations to the EAPC and Statute on Fees of the Eurasian Patent Organization (EAPO), as well as in the session of the EAPO Working Group on Budget to consider the EAPO Annual Report for 2000, EAPO Draft Budget for 2002 and draft of the Financial Regulations to the EAPC as amended.

The AC EAPO heard the information of the Plenipotentiary Representatives of the Russian Federation, A.D. Korchagin concerning the activities of the WIPO Policy Advisory Commission, and approved a decision to submit to the WIPO a Declaration of the Plenipotentiary Representatives of the EAPC Member States on supporting the re-election of Dr. Kamil Idris on the post of the WIPO Director General. During the AC EAPO meeting, the Plenipotentiary Representatives of the Russian Federation, A.D. Korchagin was unanimously elected as Chairman of the Administrative Council. The Plenipotentiary Representative of Armenia, Mr. S.L. Kantardjan and the Plenipotentiary Representative of Azerbaijan Mr. Seidov Mir Yagub Mir Abbas-ogli were elected as Vice Chairmen of the Administrative Council.

The specialists of the Rospatent and Federal Institute of Industrial Property attended a Seminar on Information Technology which was held in May 2001 (Dushanbe, Tadjikistan) by the EAPO in cooperation with the National Center for Patents and Information of the Republic of Tadjikistan.

9.9. Cooperation of Rospatent with other organizations

On April 2001 a meting of the Consultative Group on IPR Protection and Enforcement for Investments of the Economic Commission for Europe (EEC/UN) was held in the Rospatent premises with the participation of the representatives of national and private sectors of industry of the Russian Federation, public organizations in the field of copyright and Rospatent.

According to the assignment of the Russian Federation Government, Rospatent participated in the opening ceremony of the 92th International Salon of Inventions «Lepin Concur» (April 27 to May 8, 2001).

The Rospatent made preliminary selection of inventions for Russian exposition in the Salon. 46 exhibits were displayed by Russia. The International Jury of the Salon highly estimated the developments of the Russian inventors. A certain number of them were awarded by decorations of the Salon.

On November 2001 Rospatent, according to the assignment of the Russian Federation Government, took part in regular 50th World Salon of Innovations and New Technologies «Brussels-Eureka 2001» in which the achievements of inventors from 46 countries were displayed. About 800 exhibits included more than 1200 inventions.

The Russian exposition consisted of 195 subject matters of industrial property and was formed by the Ministry of Science and Technology, Rospatent, Ministry of Education, Russian Space Agency, RASY, RAOV, Russian Academy of Sciences, NTA «Technopol-Moscow».

The International Jury highly estimated the participation of the Russian inventors in Salon. The most part of Russian inventions were decorated, including 25 Superior Gold Medals, 70 Gold Medals, 74 Silver Medals, 11 Bronze Medals and 15 Diplomas.

Within the framework of cooperation under the Council of Baltic Sea States, Rospatent prepared the proposals to the Plan of Actions of the Working Group on Economical Cooperation and IPR, which reflect the Russian interests in the States of Baltic Sea Region.
