Dear Sirs,

I have the pleasure of bringing to your notice the Annual Report on the activities of the Russian Agency for Patents and Trademarks. The Report presents the main results of Rospatent activities in the year 2003, regarding each of major orientations within the Rospatent competence.

The summing up of the past year is usually associated not only with the analysis of works carried out, but also with the formulation of future tasks. No matter how impressive a list of works and achievements of the previous year may be, there is always a field to further develop and improve the Office's work, especially as the sphere of its activities is associated with such a multifaceted problem as the development of intellectual property frameworks. While appraising the results obtained, I would like to concentrate your attention mainly on what we will have to do in the near future.

The problems facing Rospatent are intimately associated with common problems posed by the President of Russia before the Government of the Russian Federation in regard to transition of our country to Knowledge Economy. The immediate tasks confronting Rospatent directly should be regarded in the context of these nation-wide problems. Among the main orientations for the year 2004, I would like to give prominence to the following:

  • Improvements in the law enforcement practice in accordance with new laws in the field of intellectual property and, in this respect, the most use by Rospatent of all available means to organize training in the Russian regions, in order to increase the awareness of representatives from law enforcement authorities, courts and the public prosecutor's office of the foundations of intellectual property law.
  • Development of a statutory legal base in the field of intellectual property protection, including with respect to secret inventions, copyright, suppression of unfair competition;
  • Completion, in cooperation with other interested ministries and offices, of the development of legal mechanisms of commercialization of achievements of scientific and technological activities and incentives, that ensure the implementation of innovation policy of the State;
  • Development of a program for providing information support to regions, as regards the most efficient use of Rospatent information resources in all Russian regions, including national scientific centers and towns; provision of creators, developers and consumers of new technical solutions and technology with ever growing range of services in the field of patent information.

In parallel with these nation-wide problems, we are facing intradepartmental problems, such as further development of statutory and technological bases for switching the Office's work to paperless technology within the next two or three years; pursuance of works aimed at computerizing the Office, in order to reduce labor expenditure and raise labor productivity, develop personnel policies in an effort to attract and retain young people within Rospatent. The solution of these problems will serve to improve the legal protection of intellectual property rights.

Section 1. The Main Results of Activities of Rospatent in 2003

The basic challenges and orientations in the formulation and implementation of a uniform state policy regarding the legal protection of industrial property, computer programs, databases and topographies of integrated circuits consisted in the completion of a final stage of works carried out at Rospatent with the aim to improve the laws now in force, to meet the international commitments of the Russian Federation as regards the bringing its legislation into line with the world standards effective in the frameworks of the WTO and European Union.

This stage was accomplished with the entry into force (March 2003) of the Federal Law «On Introduction of Changes and Amendments to the Patent Law of the Russian Federation».

Throughout the year, works were being carried out, in cooperation with a large number of Federal Executive Authorities, regarding the draft laws “On Trade Names” and “On Introduction of Changes and Additions to the Federal Law “On the State Registration of Legal Persons”. In a sum total, these draft laws must fully regulate matters associated with the grant in the Russian Federation of the legal protection to a trade name, fill up the existing gaps in the legislation now in force, guarantee the observance of rights of the trade name owners, right holders of other intellectual property titles, and also the observance of rights and legitimate interests of consumers. It is anticipated that in the year 2004 this work will be in progress in the framework of an extended draft law concept.

Works initiated in 2002 were in progress to ensure conformity compliance of statutory legal acts with an amended and supplemented legislation in the field of intellectual property protection. As a result, during 2003 some twenty statutory legal acts of Rospatent aimed at implementing the provisions of the amended laws on the protection of intellectual property were approved and put into operation.

In view of the approaching (in the year 2004) entry into force of the provisions of patent legislation regarding secret inventions, throughout the reporting year works were being carried out to reflect peculiarities of this protective title in the existing statutory legal acts. As a result of the entry into force (as of January 1, 2004) of the provisions of patent legislation regarding secret inventions in the territory of the Russian Federation, Rospatent put into effect six statutory legal acts. It should be pointed out that the activities regarding the development of a normative legal base in respect of secret inventions will be in progress in the year 2004, in particular concerning the interaction with other Federal Executive Authorities duly authorized in this field.

It is planned to complete in 2004 joint works with the Ministry of Anti-Trust Policy and Business Support of the Russian Federation as regards the regulation of procedures for interaction on various issues associated with the suppression of unfair competition, as well as with the Ministry of Health of the Russian Federation as regards a complex regulation of problems concerning medicines.

The contents of statutory legal acts, which became effective in 2003, allow one to suggest that there has been created a considerable number of prerequisites for the efficient application of the amended laws on the industrial property protection and some other rights of intellectual property.

In the year 2003, works were in progress to improve the legislative base in the field of copyright and neighboring rights.

Throughout the year works were being continued regarding a draft Federal Law “On Introduction of Changes and Amendments to the Law of the Russian Federation ‘On Copyright and Neighboring Rights’”, with due regard for more than 150 changes and additions introduced thereto, in order to submit the draft for the second reading by the State Duma. At present a draft Decision of the Russian Federation Government “On the Minimum Rates of Author’s Fees for Using Copyrights” and a draft Decision of the Russian Federation Government “On the Minimum Rates of Remuneration for Using Neighboring Rights” are under elaboration. A draft Federal Law “On the Collective Administration of Economic Copyright and Neighboring Rights” has been worked out. Works with the drafts of the above statutory acts will be in progress in the year 2004.

A draft Federal Law “On Introduction of Changes and Amendments to Parts I, II and III of the Civil Code of the Russian Federation” was worked out and submitted to the Governmental Commission on the Counteraction to Infringements in the Sphere of Intellectual Property.

Drafts of the statutory acts “On the Accession of the Russian Federation to the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty” were prepared. The accession to these WIPO Treaties will become possible after the adoption of the Federal Law “On Introduction of Changes and Amendments to the Law of the Russian Federation ‘On Copyright and Neighboring Rights’”.

The year 2003 was marked by activation of works in the framework of the Information Council of Rospatent, which was established in August 2002. During the reporting period, 53 Russian and 19 foreign mass media were accredited with Rospatent at their request.

The Information Council regularly organized the information support for conferences, seminars and other events held by Rospatent, made information on the most important events in the intellectual property field available to the general public, mass media, ministries and offices.

As a whole, the major results of the activities carried out by the Information Council consisted in an efficient interaction of Rospatent with mass media, a regular dissemination of official information regarding activities of the Office and a significant increase in the public awareness of the activities of Rospatent.

In the context of the state policy of commercializing the results of scientific and technological activities, works were underway to elaborate draft documents as to the implementation of main orientations in the commercialization of the results of scientific and technological activities created at the expense of the state budgetary means. Rospatent worked out and submitted to the Ministry of Industry, Science and Technology proposals on the establishment of the system for economic incentives for commercializing the results of scientific and technological activities and intellectual property rights, proposals on the procedure for dealing with rights of the Russian Federation in the results of scientific and technological activities created at the expense of the state budgetary means, proposals on the development of a systematic project of a single national system for the evaluation of scientific and technological results, products and services and control over their use. On the instructions of the Russian Federation Government, the Methodological recommendations on the issues of the evaluation, legal protection and exploitation of the results of scientific and technological activities were prepared by Rospatent for publication.

Rospatent also prepared and submitted to the State Duma Committee on Education and Science its proposals regarding the legislative provision of the use of scientific and technological products in the commercialization. Rospatent worked out and submitted to the Ministry of Economic Development and Trade of the Russian Federation proposals on the draft program of the social and economic development of the Russian Federation for a medium-term perspective (2003-2005). On the instructions of the Security Council of the Russian Federation, Rospatent worked out and submitted to the Security Council of the Russian Federation a section in the draft Foundations of the policies of the Russian Federation in the field of exploitation and legal protection of the intellectual activity results for the period up to 2010 and a further perspective. Proposals regarding the forms of interaction on the issues of the industrial property legal protection were prepared and submitted to the Ministry of Anti-Trust Policy and Business Support and the Ministry of Internal Affairs of the Russian Federation.

Rospatent continued its works with the Russian regions. In 2003, works on the Program of cooperation with regions of the Russian Federation were aimed at ensuring the creation, legal protection and exploitation of scientific and technological achievements.

All in all, at present Rospatent has entered into agreements on cooperation with administrations of 19 regions.

A program of the information provision of regions was worked out. In the context of this program, free access through the Internet to full-text databases of domestic inventions was provided to 22 regional key organizations, seven scientific towns and over 30 public scientific centers of the Russian Federation.

A total of 40 employees of Rospatent and the Federal Institute of Industrial Property took part and made presentations in more than twenty scientific and practical seminars and conferences on the problems of intellectual property held in 2003 in such cities as Kemerovo, Saint Petersburg, Tula, Tolyatti, Tver, Kaluga, Samara, Khabarovsk and Yaroslavl.

In an effort to promote inventive activities, Rospatent participated in the organization and holding of a number of Russian and International exhibitions and fora, including the 6th International Salon of Industrial Property “Archimedes-2003” and the 3rd Moscow International Salon of Innovations and Investments, the 94th International Salon of Inventions “Concours Lepine” (Paris, France), the World Intellectual Property Day, the All-Russia Exhibition — Forum “Russian Regions: Protection Against Counterfeiting” the 52nd World Salon of Innovations, Scientific Developments and New Technology “Brussels-Eureka 2003” (Belgium).

The international cooperation of Rospatent in the year 2003, as in the previous years, was carried out on the basis of long-term objectives and goals, which had been defined before, and also on the basis of long-term agreements, plans and commitments with foreign partners. In the course of this cooperation the following practical aims were put forward and solved: reduction of expenses in the process for improving the Rospatent system; receipt of organizational and methodological assistance; reflection of interests of the Russian Federation and a position of Rospatent in the international agreements to be worked out or amended; participation in mutually advantageous international projects; provision of support to other Offices, primarily to the CIS Member States and developing countries. A certain part of works (in the context of WTO, EC and APEC) were performed on the instructions of the Russian Federation Government.

Mention should be made of the following most significant achievements.

In the context of EPO, the heads of Offices signed a new Agreed Minutes on Technical Cooperation between EPO and Rospatent for 2003-2004. Arrangements were reached and an agreement signed on the inclusion of Rospatent in the EPO information network PATNET (under this agreement, network equipment was sent to Rospatent). In addition it is planned to provide access to the Russian patent information in the framework of All-European Retrieval System designed for the general user (ESPACENET).

On the basis of an agreement with EAPO, examiners of Rospatent were provided with access to the EAPO searching database (EAPATIS) on the Internet, which enables searches in the collections of documents of the CIS Member States and access to the Internet-resources of the leading Patent Offices of the world. An important element of this database is the patent information of Rospatent, which is presented to render assistance to the CIS Member States in their access to the Russian patent documentation.

In the context of bilateral agreements, exchange of patent documents on traditional and electronic data carriers was in progress with 67 foreign Patent Offices and international organizations, thus allowing the acquisition of the State Collection of Patent Documents at Rospatent and dissemination of patent data on preferential terms for the Russian experts. In cooperation with the Federal Patent Court of Germany Rospatent organized and held three international seminars. There were also prepared and signed TACIS Projects under which seminars and conferences will be held in 2004, primarily for the employees of patent services, law enforcement authorities, patent examiners and patent attorneys.

In the context of participation in the elaboration of new agreements and revision of contracts concluded earlier, Rospatent took an active part in the preparation of intergovernmental agreements on scientific and technological cooperation with foreign countries to be elaborated by other agencies on the instructions of the Russian Federation Government. In the framework of this mission Rospatent worked out proposals and conclusions with respect to six drafts of intergovernmental agreements concerning “Intellectual Property”. Intergovernmental agreements were elaborated and concluded with the Office on Inventions of the Democratic Peoples Republic of Korea, the Intellectual Property Office of Mongolia and the Ministry of Education and Science of Ukraine. There was also signed an Agreement between the Government of the Russian Federation and the Executive Authority of Georgia.

Cooperation with the World Intellectual Property Organization (WIPO) represents an important aspect in the international activities of Rospatent.

In the context of cooperation with WIPO, Rospatent was a co-organizer of the International Forum on Genetic Resources, Traditional Knowledge and Folklore attended by 160 specialists from WIPO, EAPO, various offices and organizations of 19 foreign countries.

Rospatent took an active part in the works on the revision of the Patent Cooperation Treaty (PCT).

In the framework of activity concerning accession of the Russian Federation to the Patent Law Treaty (PLT), Rospatent prepared a package of documents which was forwarded for coordination to the Ministry of Foreign Affairs of the Russian Federation for purposes of interstate procedures on the accession to the Treaty.

There was also prepared a draft document to be submitted to the Government of the Russian Federation for purposes of interstate procedures on the adoption of the 1999 Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs.

An important result of Rospatent participation in the activities of the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) consisted in the preparation of drafts of a model treaty on the access to genetic resources and benefit sharing and also of methodological recommendations on the accounting and dissemination of intellectual property rights in this treaty. On the whole Rospatent employees participate in works of 18 WIPO Committees and Working Groups.

In the framework of the Intergovernmental Council on the Industrial Property Protection (IGC) of the CIS Member States, Rospatent put forward an initiative to start works on the harmonization of national laws of the CIS Member States, with due regard for the provisions of international agreements in the field of industrial property (TRIPS, PLT, TLT), as well as to elaborate recommendations as to account and evaluation of intellectual property rights, including determination of main orientations in the implementation by the CIS Member States of a policy for commercializing achievements of scientific and technological activities.

Rospatent as a producer of works on the production of a joint regional patent information product of the CIS Member States enabled the production of the CISPATENT disk and inclusion of the information product in the international exchange with leading foreign offices of Austria, Canada and USA.

The main challenge of the year 2003 in respect of examination and registration of industrial property titles consisted in the fulfillment of the established planned works as regards the acceptance and qualitative examinations of applications for industrial property rights.

As a whole, the amount of applications for the grant of a patent for invention was 8.2 percent above as compared to the previous year, with respect to all categories of applicants.

The receipt of applications for utility models exceeded the 2003 level by 13.7 per cent, that of applications for industrial designs increased by 38.2 per cent, mainly at the expense of Russian applicants.

As to trademarks, despite the growth in the receipt of applications under the international procedure (11.3 per cent), the overall amount of receipts decreased considerably (by 19 per cent) at the expense of applicants from Russia and far abroad.

Moreover, the department for the registration of computer programs, databases and topographies of integrated circuits accepted in 2003 more applications than in 2002 by 19.0 per cent.

Thus, in the year 2003 more applications were received and accordingly treated than in the year 2002 with respect to all industrial property rights, except for trademark applications.

Much attention in the year 2003 was given to the issues of improving the process and information provision aimed at reducing labor expenditure with regard to the main types of examination works and rising labor productivity and quality when examining applications for industrial property rights, as well as reducing the time periods of examination.

In 2003 work was in progress as regards control of the examination quality and reduction in the time periods of examining applications.

As a whole the efficiency of works aimed at improving quality of examination of applications for the industrial property rights is supported by decrease in the amount of complaints recognized to be justified, from 9 per cent to 6 per cent of the total amount of appeals examined.

Apart from the objective of improving quality of examination, recommendations were worked out with respect to the performance of examination of applications for inventions of complex categories associated with gene engineering, biotechnology, combinatorial chemistry, as well as improvements in the process provision aimed at decreasing labor expenditure, including by means of paperless technology transition.

The main challenges with respect to official publications were a smooth issue of official publications while strictly observing the established schedule; expeditious issue of non-periodicals; expansion of the range of official publications on optical disks; increase in the number of subscribers and of copies printed. The results of the year 2003 show that Rospatent met these challenges successfully.

In 2003, works in the field of automation were carried out in the following three main orientations:

  • the development of new means for providing the Russian consumers with information on intellectual property based on modern information technology;
  • the adaptation of operating automated systems to a new normative and technological base introduced with the adoption of new laws;
  • the all-round modernization of Rospatent’s automated systems on the basis of up-to-date architectural solutions, software products and information technology.

Notable results of the reporting year consisted in the completion of a preparation for the issuance of databases containing a backlog array of national inventions for the period 1924-1993 on DVD-ROM disks, which will allow the restoration of patent collections in the entire territory of Russia; the development of a technique for keeping the Internet-based open register of all industrial property rights, which will enable all users to have a free access to databases’ information updatable constantly, said information comprising a complete specification of patent documents and their legal status; the development and introduction of a technology and software for creating and keeping the electronic bulletin of trademarks on optical disks and on the Internet; the creation of an integrated environment for servicing users on the basis of patent information products of Rospatent on CD-ROMs, DVD-ROMs and databases on the Internet; the development of a system of electronic publication of inventions of the CIS Member States on CD-ROM disks.

In addition, all operating automated systems of Rospatent (more than 100 programs) were updated and modernized. In accordance with a Project “Rospatent 2000”, an all-round modernization of a number of automated systems was initiated in cooperation with the company Siemens.

Training of specialists representing ministers, agencies and enterprises of different forms of property is of fundamental importance in the activities of Rospatent.

The main challenges in the year 2003 in this respect consisted in the organization and holding of events aimed at:

  • studying and mastering by the employees representing outside organizations, primarily the Federal Executive Authorities, of the provisions of the Russian Federation legislation:
  • acquaintance with the fundamentals of the international intellectual property law.

In the year 2003, a new lecture cycle was established for the employees of the Federal Executive Authorities, said cycle comprising two training stages: the first stage — for those specialists who failed to pass training at Rospatent (36 hours), and the second stage — for those who passed training earlier (26 hours). The training involved 259 specialists from 21 Federal Executive Authorities.

In 2003, a distance learning in the Russian language under the WIPO Worldwide Academy (WIPO WA) entitled “Introduction to Intellectual Property” was opened in Russia for the interested persons from Russia, CIS countries and far abroad. Rospatent organized this learning in the framework of cooperation with the WIPO WA. Three sessions were held during the year. A total of 1,606 individuals were registered and provided with access to materials of the learning course and 926 individuals were given WIPO WA certificates of the successful completion of the course. Among them were employees of the State executive bodies, lawyers, judges, employees from patent offices of CIS countries, patent attorneys, teachers, scientists, researchers, students, etc.

In collaboration with the Ministry of Education of the Russian Federation Rospatent initiated the elaboration of the issue of the incorporation of an obligatory component of the intellectual property law into the state educational standards.

As far as works with patent attorneys are concerned, the main challenge in the year 2003 consisted in the perfection of a statutory legal base. The Rospatent qualification commission amended and approved a Procedure for carrying out qualification exams for a professional certification of patent attorneys, a Program of qualification exams for a professional certification of patent attorneys, and a List of statutory acts the knowledge of which is necessary in the qualification exams. With the goal of certifying specialists with higher professional skill in theory and practice, the members of qualification commission worked out tasks for computer testing and a written work, taking into account the amended laws in the field of industrial property. As of the end of the year 2003, there were registered 918 patent attorneys, including 68 persons registered for the first time in 2003.

Financial activities of Rospatent in 2003 were carried out under conditions of financial and budgetary legislation in force in the Russian Federation and a purposeful financing of Rospatent expenditure in all spheres of its activity and development.

Indicators on revenues tabulated in Table 1.1 characterize remittance of the receipts to the Federal budget of the Russian Federation according to relevant sources. A sum total of means from payment of patent fees and fees for the official registration introduced into the income of the Federal budget has been formed on the results of paying patent fees according to the rates set by the Russian Federation Governmental Ordinance, dated January 14, 2002, No. 8, and proportional expenses of Rospatent.

The structure and level of expenditure tabulated in Table 1.2 have been formed in response to the necessity to carry out works aimed at improving the main information and technology processes, said necessity dictating total investments in this process and expenditure regarding other capital costs.

New Building of FIPS

The construction of a new many-storied building performed at the expense of means provided from the Federal budget of the Russian Federation has been completed. In this connection, necessary conditions have been created to enable the operation of automated systems updatable, improvements in the working conditions of Rospatent employees.

In connection with the increase in tariff rates of a Unified tariff rate of the labor remuneration of budgetary employees, in October 2003 there was a wage increase (in accordance with the Russian Federation Governmental Ordinance, dated October 2, 2003, No. 609) regarding the employees from organizations constituting Rospatent and relating to the budgetary sphere.

A level and dynamics of other expenditure have been formed depending on economical conditions of activities of budgetary organizations of the Russian Federation effective in corresponding time periods; the amount of works to be performed by Rospatent and their material and technical provision; as well as the amount of granted expenditure with respect to maintenance of the state property. These factors provide an explanation for the increase in general-and-administrative and business expenses in 2003 as compared to the year 2002.
