5.1. The State Patent Collection

The State Patent Collection (hereinafter referred to as the “SPC”) is a totality of information sources stored on all kinds of media (systematized and provided with a complex of indices and reference aids) which relate to all industrial property rights including registered computer programs, databases and topographies of integrated circuits, and comprise patent documents, patent associated literature, patent law related publications, normative and methodological literature and other scientific & technical publications for reference purposes.

In 2006 the SPC was updated with national patent documents as well as foreign patent documents through international exchange with the Patent Offices of 57 countries, six international organizations (in 2006 exchange with IP Office of Italy and information company “Derwent Information Ltd” was discontinued).

The structure of the international exchange of patent documents with foreign Patent Offices is illustrated by data shown in Table 5.1.1.

The most important tasks dealt with in 2006 in relation to the SPC were as follows:

• improvement of information technologies used for the purposes of the maintenance of the SPC;

• improvement of the structure and status of information resources aimed at reducing labor costs while using them.

The main constituent parts of the SPC are now the Central Patent Collection (CPC) and the State Patent Examination Collection (SPEC). These collections are organized as the independent collections of patent documents with different tasks and have some peculiarities inherent to the their acquisition and structure.

5.2. Acquisition of the Central Patent Collection

The CPC comprises a collection of national patent documents (since 1814), collection of foreign patent documents of various countries with a varying retrospective depth, collection of abstracts and bibliographic data publication relating to all titles of industrial property, collections of patent associated, patent law related, normative and reference-related literature, as well as a set of Indices and other reference and search aids to these collections.

As of January 1, 2007 the CPC amounted nearly to about 80 million copies of patent documents stored on different types of media.

In the reporting year there was a further increase in the number of incoming national and foreign documents on CD-ROMs (some 3 million copies of patent documents were received). At the same time new receipts of documents on paper were practically ceased.

During 2006 the CPC was supplemented with the following new electronic products on optical disks ( see Table 5.2.1).

The total number of various Databases included in the CPC amounts to more than 200 which are stored on about 40 thousand optical disks (CD-ROM, DVD-ROM, CD-R).

Access to the Central Patent Collection

The CPC is used for servicing all the categories of users without any restrictions. An ever growing interest is shown by users for the collections of patent law related and legal literature as well as dictionaries and reference aids (see Table 5.2.2)

5.3. The State Patent Examination Collection

One of the most important integral parts of the State Patent Collection is the State Patent Examination Collection (SPEC) which is presented both on paper and machine-readable media.

The Composition and content of the SPEC is regulated by the Rule 34 of the Regulations under the Patent Cooperation Treaty (PCT) to which Rospatent is party and determined also by bilateral treaties and agreements with other Offices.

The SPEC is intended for servicing only state examiners on the basis of open access.

Each year the current part of the SPEC is updated both with national and foreign patent documents.

In 2006, a total of 365, 7 thousand specifications, including 312, 1 thousand foreign and 53,6 thousand national documents were added to the SPEC.

A part of the SPEC stored on paper includes the collections of national and foreign documents arranged according to the IPC as well as collections of patent law related literature, scientific and technical publications and reference literature including dictionaries.

As of January 1, 2007, the SPEC on paper comprised 19,1 million patent documents of the ex-USSR, Russia, the USA, Great Britain, France, Germany, Switzerland, Japan, Australia, Austria, Canada, World Intellectual Property Organization, the European Patent Organization and the Eurasian Patent Organization, as well as patent documents from the CIS countries including more 176 thousand scientific and technical books and journals.

In 2006 the principles of compiling the examination collection on optical disks underwent a change: on the basis of an analysis of a real use of optical disks by users it was decided to move a part of the SPEC stored on disks to the CPC.

By the end of 2006 the examination collection on optical disks contained 99 databases stored on 7957 disks (CD-ROM and DVD-ROM) containing the information from 22 countries and 4 international organizations.

5.4 Official and Informational publications

In January 2006 Rospatent continued to issue its Official Bulletins — “Inventions. Utility Models” and “Trademarks. Service Marks. Appellations of Origin” on electronic media (CD-ROM) equipped with a search system. During the reporting year the Official Bulletin “Industrial Designs” was converted to an electronic format.

In 2006 the following Bulletins were issued on electronic carrier (CD-ROM) equipped with a search system:

• “Inventions. Utility Models”, 36 Issues (disks);

• “Inventions. Utility Models” (full-text specifications), 36 Issues (disks);

• “Trademarks. Service Marks. Appellations of Origin”, 24 Issues (disks);

• “Industrial Designs”, 12 issues (disks).

In 2006 the Bulletin “Computer Programs. Databases. Topographies of Integrated Circuits” continued to be issued on paper — 4 issues, 154 publishing pages.

During the reporting period the following information was published in the Official Bulletins:

• 47,117 announcements on inventions, including: 23,302 patent claims for inventions, 21287 application claims, 2,528 claims to patents not published before;

• 9,573 utility model claims;

• 2,675 announcements on industrial design patents;

• 189161 announcements on trademark registrations;

• 22 announcements on the registration of appellations of origin;

• 4151 computer program annotations;

• 378 database annotations;

• 33 annotations to topographies of integrated circuits.

For all titles the corresponding protection documents were prepared and sent out to the right owners.

From 2005 on full specifications for inventions including the title pages of utility models are produced on paper as a by-product copy from electronic publication. In the year 2006 a total of 23,302 patent specifications (14,037 publishing sheets) and 9,573 title pages of utility model descriptions (498 publishing sheets) were published.

In 2006, in addition to Official Bulletins for 2005, a number of the Annual Indices were produced on paper:

• for Bulletins “Inventions, Utility Models” — 5 volumes (9 Parts), 262 publishing pages;

• for Bulletins “Trade marks, service marks and appellations of origin” — 3 volumes, 56 publishing pages.

• for Bulletin “Industrial designs” — 1 volume, 2.4 publishing pages;

In 2006 the Annual Report of Rospatent for 2005 was prepared and issued.

Besides the Official Bulletins on CD-ROM, their paper copies were published which contained the information being equal to that contained in the respective Bulletins: “Inventions, Utility Models” – 36 volumes, 5,082 publishing pages; and “Trademarks, Service Marks and Appellations of Origin” – 24 volumes, 2,040 publishing pages and “Industrial Designs” (12 volumes, 399 publishing pages).

5.5. Supply of Information Services to the Users

The State Patent Collection is used as a basis for patent and information service of the specialists of Rospatent, examiners of FIPS, experts of subordinate organizations of Rospatent as well as other interested users from the Russian Federation and the CIS countries as well as users from other countries. In addition a selected range of information publications are prepared and distributed, a remote access to databases of Rospatent is provided via the Internet

Main characteristics of Library-type information services provided by the Patent Library (FIPS Department) on the basis of the SPC during the last four years are given in Table 5.5.1.

It should be noted that among the users of the CPC a relative growth of students of various Universities was observed (in 2006 the number of students amounted to 38% of the total users registered).

During 2006 the Patent Library organized 34 tours and hand-on workshops for acquaintance with patent documentation in which 654 students of Moscow University were involved.

In 2006 over 20 thousand requests for patent information services were carried out for visitors of the Patent Library and for remote regional and foreign subscribers.

Among the main users there were major industrial organizations, Science Centers, Educational Institutions of the Russian Federation and private persons as well.

In the recent years an ever growing interest is shown for patent information services provided by the Patent Library. Thus, in 2003 about 700 organizations and private persons made use of the above services; in 2004 the number amounted to 951, in 2005 to 894 and in 2006 to 941).

The set of information products produced by the FIPS in 2006 reflects the previous trends of transferring publication of Rospatent Official Bulletins to electronic form.

In 2006 the Official Bulletins “Inventions. Utility Models” and “Trademarks, Service Marks and Appellations of Origin” which had been issued on electronic carrier (CD-ROM disks) from 2005 were supplemented by the issue of the Official Bulletin “Industrial Designs” which started to appear instead of the traditional Bulletin on paper with the same regularity and was posted on the website of Rospatent (see Table 5.5.2.).

For searching in the back-file collections the current information for 2005 was produced on cumulative DVD disks, the latter being offered to subscribers in 2006 as a continuation of previously issued retrospective files of the corresponding industrizl property titles. A quick access to the accumulated collection of invention specifications on CD-ROM's and DVD was provided by search and reference aids which were represented by a comprehensive set of Indices containing the abstracts information with references to full-text specifications which were located on optical disks and on website of Rospatent. (see Table 5.5.3.)

From 2006 a similar set of Indices and search aids located on DVD disks was offered also in respect of patent specifications of the CIS countries and the EAPO (the so called integrated Regional Index — CISPATENT Access).

New possibilities for a sophisticated searching of patent documents were offered in 2006 by the implementation of the 8-th Edition of the International Patent Classification (IPC-8) developed as a result of the IPC Reform and distinguished by its two-level structure having a core and advanced levels. In accordance with this structure the users were offered two versions of the IPC whereas, in order to comply with wishes of subscribers, the said versions were presented not only as a search system on a CD-ROM disk, but also on paper. The new edition of the IPC was also posted on the Web-site of Rospatent.

In order to increase the efficiency of the use of the International (Nice) Classification of Goods and Services a Reference tool “Lexical and Semantic Identifier of Services and Goods” was developed in FIPS what facilitated to establish the identity of services and goods on the basis of terminology of the Nice Classification (8-th Edition) and to deal with some other searching problems. The subscribers were also offered for the first time the Russian–Language Version of the WIPO publication of the International (Vienna) Classification of Figurative Elements of Marks (5-th Edition).

The development of electronic publications allowed the users to give up the use of the respective information on paper and to switch over to its more effective use in a computerized mode. At the same time, taking into account certain technical problems which were experienced by some of subscribers in handling optical carriers, issues of the Bulletin and some other patent information products on paper was continued in 2006 on their request (see Table 5.5.4).

The above indicated circumstance was taken into account while calculating prices for the information products offered in 2006. Thus, the prices of official publications distributed on optical disks as a basis of the information product system were frozen at the level of 2005 what, in the circumstances of the existing inflation, could mean their actual reduction. Prices for some publications on paper were increased since they had to be brought in line with the level of costs required for their production and distribution. Thus, the users were offered a possibility of choice in respect of the medium of the information of interest and its real cost.

The number of subscribers to official information products remained rather stable during past years (see Table 5.5.6), whereas the main bulk of subscribers constituted those of the Russian Federation (see Annex 4). The most active users of the official information constitute organizations which are engaged in research activities and in industrial production (see Table 5.5.5.)

Access to an extended set of databases was provided through the website of Rospatent what reflected a dynamic process of development of electronic Official publications (see Chapter 4.2 of the Report).

The content structure of the website of Rospatent was developing in a dynamic way and was extended to cover an ever growing range of activities directions of Rospatent. In 2006 new headings and subdivisions which reflected main activity directions of the Intellectual Property System in Russia were introduced. Thus, there were introduced such new subdivisions of the site as “Papers and Reports of the Management of Rospatent” and “Strategic Plan and Development Program Documents” which cited documents reflecting the position of Rospatent on key problems of the development of Intellectual Property Protection System in Russia. The newly created site section “Use of Research and Development Activities Results” is designed to inform the public about the results as to how Rospatent performed its control and supervising functions in the area of the use of intellectual property rights.

For enhancing the awareness of the interested public about works carried out by Rospatent in the area of development of the Intellectual Property System the website of Rospatent regularly provided for a discussion of the decisions taken in this area.
