4.1 Program of the comprehensive modernization of the automated systems (2007)

Within the implementation of the program for the comprehensive modernization of Rospatent's automated systems, in the year under review the following works were completed or continued:

  • An automated system "Court decisions" providing for electronic turnover of documents was put into operation. The database of this system is continuously updated with electronic documents what allows Rospatent to take part in court hearings on various industrial property litigation cases. The system was integrated with the publishing system on court decisions relating to trademarks;
  • A new InHouse Information and Reference system called "Portal FGU FIPS" was put into operation; the system stores over 5,000 documents of various type and represents a part of internal site, the access to which is differentiated in entitlement; it contains a section "News" and an updated telephone directory.
  • An Automated Library System (ALS) was put into experimental operation; an integrated database covering data on national and foreign patent document literature was created; the system allows the registration of new readers and issue of reader's entry cards of new type; the input of new documents is carried out in compliance with the Library Standard RUSMARK.
  • The experimental operation of a new search system designed for the examination of trademarks "TMEXAMSEARCH" was continued. The transfer of data from the existing automated system "TZ RF" to the new one was continued including actions ensuring the interconnection between two systems, backlog indexing and revising the rules for terminology handling and choice;
  • The software for the second version of an automated system for processing and managing electronic document flow during trademarks examination (referred to as the "TMADMIN") was delivered to a full extent; works were completed in order to integrate the automated search system "TMEXAMSEARCH" and system "TMADMIN" with currently operating automated systems for trademarks (newly developed applications: "Patent Attorneys of the Russian Federation", "License Agreements and Contracts" , "Changes and Amendments to Registrations" and "Court Decisions"). Pending applications which were added to the automated system "Trade Marks in Russia" were converted into electronic format.
  • A new software extending the functionalities of the automated system "Electronic Dossiers of Applications" relating to inventions and utility models was delivered; new Working stations for the personnel engaged in updating and monitoring of electronic dossiers of applications were installed;
  • The automated system "Digital Library of the PCT Applications" was developed and put into operation; the system ensures electronic turnover of the international applications filed with Rospatent as a Receiving Office;
  • The Concept of an Integrated Computerized System "Fees and Tariffs Control" was elaborated and approved; the system will operate on the basis of electronic payment bills. Standard modules of data exchange with various Document Processing systems were developed including the software for processing fees; a Pilot system for processing fees was launched which provides for interconnection and interoperability with AS "License Agreements and Contracts" , "Changes and Amendments to Registrations"
  • An automated system of paperless preparation and transfer of data for continuous electronic publishing of the information about trademarks, wellknown marks in the Russian Federation and appellations of origin was elaborated and put into operation. The information is published on website of Rospatent usually next day after it has been entered into the Official Register.
  • The computerized system of preparing data for the inclusion into electronic Bulletin "Trademarks, Service Marks and Appellations of Origin" was upgraded. Starting from the third issue of the Bulletin in 2008 the information in the system is published by using the Mimosa Software and presented in XMLformat in compliance with WIPO Standard ST. 66.

4.2. Utilization of Internet Resources of Rospatent (2007)

In 2007 the access to the following search tools was provided on the website of Rospatent via Internet:

  • Information Retrieval System (IRS) for national patent documentation;
  • Registries of Russian Patent Documents relating to all kinds of industrial property;
  • Registry of trademarks applications filed in 2005 2007 supplemented with data relating to the examination procedure of applications filed in 2007;
  • Registries containing the information about examination results for the applications for Inventions, Utility Models and Industrial Designs filed in 2007;
  • Official Bulletins of Rospatent "Inventions. Utility Models", "Trademarks, Service Marks and Appellations of Origin", "Industrial Designs".

The Internet Resources of Rospatent include the following databases:

  • a fulltext database of Russian inventions (containing the information about 346 thousand patents for inventions covering the time period from 1994 to 2007 inclusive; being updated three times each month);
  • a backdating database of Russian patent documents presented in facsimile format (contains the information about 1, 433 thousand of patent documents for inventions covering the time period from 1924 to 1993 inclusive);
  • an abstract database for Russian inventions (containing the information about 617 thousand of applications and patents covering the time period from 1994 to 2007 inclusive; being updated three times each month);
  • an Englishlanguage abstract database for Russian inventions (containing the information about 345 thousand patents covering the time period from 1994 to 2007 inclusive; being updated three times each month);
  • an abstract database for Russian utility models (containing the information about 69 thousand of certificates and patents for utility models covering the time period from 1996 to 2007 inclusive; being updated three times each month); about 62 thousand documents of the database were supplemented with descriptions in a facsimile format;
  • a database for Russian trademarks (containing the information about 259 thousand of Russian certificates for trademarks covering the time period from 1925 to 2007 inclusive; being updated two times each month);
  • a database for International Trademarks Registrations containing designations of Russia ( about 166 thousand of international registrations with designation of Russia covering the time period from 1980 to 2007; being updated each week). The access is provided for subscribers to Trademarks databases;
  • a database for "Perspective Inventions";
  • a database "Appellations of Origin" for subscribers to Trademarks databases;
  • a database of "Wellknown Marks";
  • a database of Russian industrial designs (containing the information about 29 thousand of patents for industrial designs covering the time period from 1993 to 2007 inclusive; being updated each month);
  • a database of Russian trademarks applications filed during 2005-2007 (containing the information about 115 thousand of applications; being updated daily);
  • a data base of applications for inventions filed in 2007 (containing the information about examination process of 40 thousand applications; being updated daily);
  • a data base of applications for utility models filed in 2007 (containing the information about examination process of 9,5 thousand applications; being updated daily);
  • a data base of applications for industrial designs filed in 2007 (containing the information about examination process of 4,5 thousand applications; being updated daily);
  • a database of the Russianlanguage IPC (the 7th and 8th editions);
  • a Russianlanguage database of the International Classification of Goods and Services;
  • a Russianlanguage database of the International Classification of Industrial Designs.

Access to and use of the Information Search Systems

Access for external users to the fulltext databases of inventions, databases of utility models, databases of trademarks and databases of industrial designs is provided on a contract basis.

In the framework of the Program of Regional Cooperation between Rospatent and Regions of the Russian Federation more than 120 organizations obtained a free access to fulltext databases for inventions.

A free access for external users is provided to:

In respect of inventions:

  • Abstract databases (in Russian and English);
  • Database "Perspective Inventions";
  • Fulltext database containing documents published in three recent Bulletins "Inventions and Utility Models";
  • Database of the IPC.

In respect of Utility Models:

  • Fulltext database containing documents published in three recent Bulletins "Inventions and Utility Models";
  • Database of the IPC.

In respect of Trademarks:

  • database containing documents published in the two recent Bulletins "Trademarks, Service Marks and Appellations of Origin",
  • database "Wellknown Marks in Russia";
  • database of the International Classification of Goods and Services.

In 2007 over 780 contracts providing access to commercially available databases of Rospatent were concluded. The total number of contracts concluded during the whole period of maintenance and use of the computerized system of Rospatent amounted approximately to 6500 contracts; by the end of 2007 about 4,500 contracts were still valid.

During 2007 the number of search queries submitted by internal and external users to the IRS totaled to 3,473 thousand whereas:

  • Over 726 thousand of queries were received from internal users of the databases;
  • Over 2,740 thousand of queries were filed by external users.

The number of search sessions performed in the IRS during 2007 amounted to 780 thousand whereas:

  • over 139 thousand sessions were performed on the payment basis;
  • over 517 thousand sessions were on a freeofcharge basis;
  • over 121 thousand sessions were performed at the request of examiners.

Diagram 1 shows the distribution of numbers of queries processed by the IRS during the period of 2000-2007.



Diagram 2 illustrates the distribution of the number of queries during 2007 according to types of industrial property.

Access for users to Registries of Russian patent documents

The users of Registries enjoyed a free access to all patent documents available in Internet resources of Rospatent .

During 2007 the total number of queries submitted by internal and external users to the Registries amounted to more than 4,660 thousand whereas

  • over 190 thousand queries were filed by internal users;
  • about 4,570 thousand queries were filed by outside users.

The utilization of Official Bulletins of Rospatent by users

The users enjoyed a free access to Bulletins of Rospatent published in 20052007:

  • Bulletins "Inventions and Utility Models",
  • Bulletins "Trademarks, Service Marks and Appellations of Origin"
  • Bulletin "Industrial Designs".

In 2007 the total number of queries to electronic bulletins of Rospatent amounted to 202 thousand.

4.3. The utilization of databases on inventions, utility models and scientific and technical information for the purposes of examination of inventions and utility models

As a result of the computerization of the Office the examiners are provided with the access to the national and foreign patent information in online mode at their working places. In more complicated cases and if there is a need to access supplementary or commercial databases of patent and patentassociated information the examiners make use of the CDROM and Remote Access Room.

In this respect during 2007 the maintenance of CDROM collection for examiners provided only for updating the remaining CD databases which included the disks produced by the EPO, WIPO, OAPI, EAPO, Rospatent and CIS countries. Databases on CD such as GlobalPat, PAJ and some narrow subjectmatter search systems were also kept in the present examination collection.

By the end of 2007 the total examination collection on CDROM disks covered 99 databases stored on 8,407 disks (CDROM and DVDROM) containing the information of 22 countries and 4 international organizations.

The remaining CD collection was used by examiners in very rare cases: for searches in the CIS documentation, in some narrow subjectmatter databases and identification of a particular document which could not be found for some reasons in online mode. Mainly, the CD databases were used by some staff engaged in researches or by developers of automated systems for compiling search databases.

Some quantitative data describing the status and the use of the CDROM collection broken down by years are given in Table 4.3.1. The cited data gives evidence of a decrease of the number of disks in the examination collection and reduction of number of accesses to this collection.

The table 4.3.1. gives evidence on the reduction of the number of disks used by examiners (29 pcs) whereas the main bulk of examiners (997) who visited the CDROM Room to make searches performed their searches in online mode or with the aid of search engines available via Internet and made no use of optical carriers.

In those search rooms the examiners were offered access to databases not accessible from the working stations, in particular to commercially available databases, both national databases (e.g. those of VINITI) and foreign ones, as well as databases which are posted by Libraries on their sites in Internet, narrow subjectmatter search systems covering scientific and technical information as well as search engines provided by Google, Rambler, Yandex and other.

The number of accesses to various databases in the CDROM Room is shown in Table 4.3.2

During 2007 additional connections to the automated translation system PROMT were purchased what would enable more than 200 examiners to make use of this system in the process of the evaluation of documents identified during searches or while perusing the information on foreign sites or reading the incoming email messages.

In 2007 the CDROM Room was actively used for the purposes of training of examiners on various subjects. The training topics covered issues of electronic file handling, special software applications and electronic databases selected for information searches for the purposes of the examination. The training courses covered both the existing and upgraded software (if requested by the staff) as well as newly developed automated systems, recently acquired databases of interest and other information resources identified in Internet as useful for search purposes.

As usual, yearly training courses were organized for newly recruited examiners to train them in the use of most frequently searched databases and automated systems.

Table 4.3.3 reflects various training courses carried out in 2007, broken down by topics, categories and the number of trainees.

As a result of training, the staff who attended the courses are able to conduct searches in an unassisted way through databases or use various information resources.

4.4. Databases available for online searches for the purposes of examination of inventions and utility models

For carrying out information searches for the purposes of the examination of applications the examiners of FGU FIPS have been making use mainly of electronic databases accessible in online mode.

Primarily, these are online openaccess databases of Patent Offices and some nonpatent databases which are accessible for examiners from their working stations located in examination divisions. In 2007 the list of such databases was extended by adding two other databases: Patent abstract database of Taiwan provided with an EnglishLanguage interface and Patent documentation database of Korea providing access to fulltext specifications being translated into English.

The most frequently used Internet databases are those of Rospatent, the EPO (Esp@cenet), US Patent Office, Japan Patent Office, German Patent Office (Depatisnet), WIPO and the internal database of the EAPO - EAPATIS.

In 2007 the InHouse search system of Rospatent "Patsearch" was operated in a test mode. The said system possesses an appropriate Russianlanguage user interface and wide searching and viewing functionalities in respect of documents. The PatSearch system contains all patent documents of the former Soviet Union and Russia as well as bibliographic data and Englishlanguage abstracts of patent documents of main industrialized countries which were loaded down into the system from GlobalPat disks. Works aimed at the extension of the database of Patsearch system with patent files of other countries were undertaken.

In the reporting year restoration works were completed to provide access to the new version of the internal search system EPOQUE of the European Patent Office. At present a stable access to EpoqueNet from a single terminal is provided and qualified personnel assist the interested examiners of examination divisions of FIPS in carrying out searches.

The most frequently used nonpatent databases available in open access mode are database (DB) PubMed maintained by the National US Library in the area of Medicine and Pharmaceuticals and multisubject database ScienceDirect.

Besides, the mentioned freeaccess databases, for the purposes of examination of applications the following commercially available (paid) databases were used by examiners:

  • databases available via network STN International covering both patent and nonpatent literature. The most frequently used databases are in the area of chemistry (REGISTRY, CA, BEILSTEIN, CASREACT, CHEMCATS and other), in the area of Medicine (EMBASE, BIOSIS) and multisubject DB (INSPEC, PASCAL, COMPENDEX).
  • Patent Databases of Delphion Network. In addition to databases of major world Patent Offices and INPADOC database, the examiners of FIPS have access to Derwent World Patent Index (DWPI ).
  • Database containing patent documents of Japan in English-PATOLISe. available via QuestelOrbit. It has a wider coverage and information content in comparison with the freeofcharge Internet DB provided via the IPDL of the JPO.

Access for examiners to commercially available remote databases was provided in two specially equipped Rooms (from 4 and 10 working stations respectively) where the examiners could receive assistance in terms of advice and methodological recommendations from a qualified staff while performing searches. Remote databases available in the Online Access Room are usually searched by examiners in complicated cases where a wider range of information resources are required for the purposes of searches and those resources are not accessible from the examiner's working stations or the qualification of an examiner is not sufficient for making searches in a particular database.

During the year under review over 1,800 such complicated searches were conducted in the Remote Access Room. The majority of searches were performed in STN databases in the area of chemistry, namely REGISTRY and Chemical Abstracts (CA).

Access to databases in the Delphion Network is provided in both Remote Access Rooms from 8 working stations.

The personnel providing services in the Remote Access Room are also engaged in investigating and reviewing other online databases which could be useful for the purposes of information searches and prepare Methodological Guidelines and Manuals for examiners how to use new databases. Besides, the said personnel regularly organizes the group training of examiners on matters of the use of online databases.

In 2007 a study of other databases was undertaken and access thereto for examiners was provided. Among those databases are the following patentassociated profile databases: Plos (site of Public Science Library of the USA), DOAJ (DB containing science & technology journals of Sweden) as well as some sites of other major electronic publishing companies in the area of science and technology literature.
