5.1. The State Patent Collection

The State Patent Collection (hereinafter referred to as the "SPC") is a totality of information resources stored on any media (systematized and provided with a complex of indices and reference aids) which relate to all industrial property rights including registered computer programs, databases and topographies of integrated circuits, and comprise patent documents, patent associated literature, patent law related publications, normative and methodological literature and other scientific & technical publications for reference purposes.

In 2007 the SPC was updated with national patent documents as well as foreign patent documents through international exchange with the Patent offices of 57 countries, six international organizations. In 2007 information exchange with the Office of the Korean Peoples Democratic Republic was resumed.

The structure of the international exchange of patent documents with foreign Patent Offices is illustrated by data shown in Table 5.1.1

The quantitative characteristics of the SPC showing the dynamics of the receipt of patent documents for the last three years are given in Table 5.1.2

The most important tasks relating to the SPC in 2007 were as follows:

  • Improving information technologies used for compiling and maintenance of the SPC;
  • Enhancing information resources with the view of reducing labor costs required for their use.

The main constituent parts of the SPC are now the Central Patent Collection (CPC) and the State Patent Examination Collection (SPEC). These collections are organized as independent collections of patent documents with different tasks and some peculiarities inherent to the their acquisition and structure.

5.2. Acquisition of the Central Patent Collection (CPC)

The Central Patent Collection (CPC) comprises a collection of national patent documents (since 1814), collection of foreign patent documents of various countries with a varying retrospective depth, collections of abstracts and bibliographic data publications relating to all titles of industrial property, collections of patent law related literature, norms setting documents and various information references as well as a set of Indices and other reference and search aids to these collections.

As of January 1, 2008, the CPC amounted nearly to about 85 million copies of patent documents of all kinds stored on different types of media.

In the reporting year there was a further increase in the number of incoming national and foreign documents on CDROMs (over 4.5 million copies of patent documents were received). At the same time new arrivals of documents on paper ceased.

During 2007 the CPC was updated with the following new information products on CDROM (Table 5.2).

The total number of various data bases included in the CPC amounted to 200, they were presented on 43 thousand optical disks (CDROM, DVDROM,CDR).

Access to the Central Patent Collection (CPC)

The CPC is used for providing services to all categories of users without any restrictions.

For several recent years the collections of patent law related literature, dictionaries and reference information enjoyed a stable interest with the visitors of the Patent Library.

5.3. The State Patent Examination Collection (SPEC)

One of the most important integral parts of the State Patent Collection is the State Patent Examination Collection (SPEC) which is presented both on paper and on machinereadable media.

The Composition and content of the SPEC is regulated by the Rule 34 of the Regulations under the Patent Cooperation Treaty (PCT) to which Russian Federation is party and determined also by bilateral treaties and agreements with other Offices.

The SPEC is intended for providing services only to state examiners on the basis of open access.

Each year the current part of the SPEC is updated both with national and foreign patent documents.

In 2007, a total of 405,4 thousand specifications (354,3 thousand foreign and 51,1 thousand national documents) were added to the SPEC.

A part of the SPEC stored on paper included collections of national and foreign documents arranged according to the IPC as well as collections of patent law related literature, scientific and technical publications and reference literature including dictionaries.

As of January 1, 2008, the SPEC on paper comprised 19,5 million patent documents of the exUSSR, Russia, the USA, Great Britain, France, Germany, Switzerland, Japan, Australia, Austria, Canada, the World Intellectual Property Organization, the European Patent Organization and the Eurasian Patent Organization, as well as patent documents of the CIS countries. The SPEC included also 76 thousand books and journals in various areas of science and technology.

In 2007, the approach to compiling and maintaining of the SPEC collection on optical disks was modified. On the basis of an analysis relating to the real use of optical discs by the examiners the decision was taken to move a part of the SPEC stored on optical media to the CPC.

5.4. Official and Informational Publications of Rospatent

In 2007 the following official bulletins were published on electronic media equipped with a search system:

  • "Inventions. Utility Models" 36 Issues (disks);
  • "Inventions. Utility Models" (full text descriptions) 36 Issues (disks);
  • "Trademarks. Service Marks. Appellations of Origin" 24 Issues (disks);
  • "Industrial Designs" 12 issues (disks).

In 2007 the publication of the Official Bulletin "Computer Programs. Databases. Topographies of Integrated Circuits" was continued (4 issues; 202,5 publishing sheets).

During reporting period the following information was published in the Official Bulletins:

  • 38,589 announcements on inventions, including: 23,028 patent claims, 15,153 application claims, 408 claims to patents not published before;
  • 9,761 utility model claims;
  • 4,020 announcements on industrial design patents;
  • 22,302 announcements on trademark registrations;
  • 10 announcements on the registration of appellations of origin;
  • 24 announcements on the granting a license for the use of appellations of origin
  • 5,171 computer program annotations;
  • 419 database annotations;
  • 48 annotations to topographies of integrated circuits.

For all titles the corresponding protection documents were prepared and sent out to the right owners.

From 2005 onwards full specifications for RU inventions and utility models (title pages) are produced on paper as a byproduct copy from electronic publication. In the year 2007, a total of 23,028 patent specifications(15,677.8 publishing sheets) and 9,761 title pages of utility model descriptions (507.5 publishing sheets) were published.

In 2007, in addition to official Bulletins, a number of annual Indices were produced:

  • for Bulletins "Inventions, Utility Models" - 5 volumes, 256 publishing sheets;
  • for Bulletin "Trademarks, Service Marks and Appellations of Origin" - 3 volumes, 50 publishing sheets;
  • for Bulletin "Industrial Designs" - 1 volume, 2.8 publishing sheets.

In 2007 the Annual Report of Rospatent for 2006 was prepared and issued.

Besides the official Bulletins on CDROM, their paper copies were published which contained the information being equal to that contained in the respective Bulletins: "Inventions, Utility Models" - 36 volumes, 5,421 publishing sheets; "Trademarks, Service Marks and Appellations of Origin" - 24 volumes, 2,901,2 publishing sheets and "Industrial Designs" - 12 volumes, 612.2 publishing sheets.

5.5. Supply of Information Products and Services to the Users

The State Patent Collection (SPC) is a basis for providing patent information services to the users of all categories: specialists of Rospatent, examiners of the FGU FIPS, other subordinate organizations of Rospatent as well as interested users of the Russian Federation, CIScountries and other regions.

Table 5.5.1 shows main characteristics of information services provided by the FGU FIPS Library on the basis of the SPC.

It should be noted that among visitors to the Library there is a stable increase of the number of students coming from various Institutes and High Schools (in 2006 the number of students in comparison to the total number of visitors equaled 38 % and in 2007 rose to 39.7%).

During 2007 the FGU FIPS Library arranged 40 tours and handon workshops relating to handling of patent documentation in which 806 students of Moscow Higher Schools took part.

In 2007 over 15,3 thousand requests for patent information services were carried out for visitors of the Library (VPTB Department of the FGU FIPS) and for remote regional and foreign subscribers. The requests related to identification of patent family members, subject matter searches, identification of the number of granted patent on the basis of an application number and so on.

Among the main users there were major industrial organizations, Science Centers, Universities of the Russian Federation and private persons as well.

By the year of 2007, as a result of transfer of Official publications in electronic form, a modern electronic publishing system of Rospatent came into existence, which integrated all kinds of publications on an uniform platform providing required means of search and access to patent documents.

During 2007 the Official Bulletins covering all types of industrial property (see Table 5.5.2) were published on electronic medium whereas the most recent issues were laid open for free access on the website of Rospatent in Internet.

Besides, the information products on electronic carrier were expanded by the publication of official texts of the international classifications relating to industrial property rights which were issued also on paper. In 2007 the subscribers were offered a new version of the International Classification of Goods and Services, i.e. ICGS9.

In order to enable backfile searches the official information on industrial property rights accumulated during 2006 was aggregated on cumulative DVD disks and offered to subscribers in 2007 as a continuation of the retrospective issues produced earlier. A quick access to backlog data bases of invention specifications stored on CDROM and DVD disks was facilitated by the quarterly produced search aids containing abstracts information along with references to the fulltext descriptions of invention which were stored either on optical disks or web site of Rospatent in Internet (see Table 5.5.3).

The development of the System of electronic publications allowed the users to avoid the handling of patent information on paper and to change over to a more effective use thereof in a computerized mode. Nevertheless, taking into account some complications of the use of the machinereadable carriers and in compliance with the requests of subscribers the publishing of traditional bulletins on paper was maintained (see Table 5.5.4).

Such a dual approach made a certain impact on the pricesetting policy for the information products in 2007. The prices for official publications on optical disks representing the backbone of the information products system remained at the level of 2006 the latter meant a factual reduction of prices with a due account of a certain inflation in the country. The prices for some publications on paper were raised so that they reflected the level of costs required for their production and distribution. The users were offered a choice of the preferred medium carrying the information of interest with a due account of cost.

The most active users of official information are the organizations engaged in Research and Development activities and industrial production (see Table 5.5.5).

The number of subscribers to the official information remained rather stable during last years (see table 5.5.6), the main bulk of subscribers being the users of the Russian Federation (see Annex 4).

The website of Rospatent offered an extended set of databases reflecting the process of development of electronic bulletins and publications (see Chapter 4.2 of this Report).

The content structure of the website of Rospatent was developing in a dynamic way, and covered an ever expanding range of issues reflecting main activity directions of Rospatent. In 2007 new sections of the website were introduced which dealt with the main issues of the performance of the IPR Protection System in Russia.

In order to make aware of the benefits of inventor's activities and facilitate the promotion of the Russian R&D results on the domestic and international markets a new section on the website of Rospatent "Perspective Inventions" was introduced. During 2007 the data base relating to the perspective inventions was created and updated, the Inventory of most important Inventions was established giving rise to the inclusion thereof into the database "100 Best Inventions of Russia".

During 2007 a new Russianlanguage information resource "Filing of International Applications under PCT" was developed and posted on the site of Rospatent, which was quite new in its presentation form, very informative and convenient for navigation therein.

In 2007 the existing section "International Cooperation" was substantially revised and supplemented: materials relating to the cooperation with the WTO, the EPO, the Council of the Baltic States were added; a new subsection "Cooperation with the Interstate Council on Issues of the Protection of Industrial Property" was introduced; news and various messages were grouped under a separate heading.

Throughout the reporting year in order to collect comments and suggestions of interested parties various Administrative Regulations governing the execution of various governmental functions by the Russian Federal Service for Intellectual Property, Patents and Trademarks were posted on the website of Rospatent. The received comments and suggestions were continuously used for improving and amending of the Administrative Regulations; updated documents were published timely on site.

In 2007 the activities of the Chamber of Patent Disputes, in particular, concerning the roundtable meetings with patent attorneys were regularly highlighted on site. For this purpose the section "Federal State Institution "Chamber of Patent Disputes (FGU PPS)" included information "On Roundtable arranged by FGU PPS whereas a new heading "Issues for Discussion during the Roundtable" was opened.
