Section 4. Computerization and Modernization of Automated Systems

 

4.1. Program for Complex Modernization of Automated Systems (2008)

Within the framework of implementation of the Program for Complex Modernization of Automated Systems of Rospatent in 2008:

  • the works were carried out in order to ensure reflection of the amendments of the legislation under the Administrative Regulations of the Federal Service for Intellectual Property, Patents and Trademarks on the Fulfillment of the State Functions, following from the requirements of  Part IV of the Civil Code of the Russian Federation;

  • a new integrated automated system of fees calculation (IES “Fees”) was developed and put into operation; the system operates on the basis of the electronic payment documents, provided by the State Treasury of the Russian Federation. IES “Fees” provides the opportunity to link the extract from the Russian Treasury and the legal actions these assets are accounted for, integration with diverse systems of document processing in FGU FIPS, unification of fees calculation process in all the departments of FGU FIPS, possibility of further extend of the schedule of maintained fees and their flexible configuration. At the moment the systems of document processing on registration of the contracts on intellectual property rights, requests on changes and amendments to registrations of trademarks, appellations of origin, well-known marks were incorporated into IES “Fees”. The integration of document processing systems, supporting consideration of the requests for other legal actions, which require fee payment is planned for 2009;

  • the system of the electronic State Register of Trademarks and Service Marks, the electronic State Register of Appellations of Origin and the electronic List of Well-Known Marks of the Russian Federation (AS “ESR”) has been developed and put into testing operation. Start of the regular operation of the system is planned for 2009. The implementation of the AS “ESR” will provide the creation of a single source containing reliable and actual data from the corresponding State Registers;  reduce of labor costs for their input; prompt access to the data containing in the State Registers from the Internet as well; reliable, long-term and secure storage of legally significant documents;

  • the external Internet portal of FGU FIPS has been put into operation. It was developed under the IBM WebSphere Portal software;

  • the major stage has been completed in the development of information search system for examination of inventions and utility models PatSearch – namely, downloading and indexing of basic data searching arrays of patent documentation;

  • the basic modules of the Automated Library System (ALS) were put into operation, they support the operation of the database “Electronic Index”, the re-cataloging of the “old” documents was performed in automated mode; the opportunity of the electronic request for literature by FGU FIPS’ examiners was provided within the framework of the interlibrary subscription.

Electronic State Register of Trademarks

The Russian legislation assigns to the State Register of Trademarks and Service Marks of the Russian Federation the central role as the source of information on trademark and service marks’ registrations.

The information containing in the State Register of Trademarks and Service Marks of the Russian Federation is widely used by public, but when the State Register is maintained and stored on paper, it prevents from ensuring the necessary efficiency of receiving information on trademark and service mark registrations. In order to provide the effective access to the information on the protected objects, the informational registers, e.g. on trademark and service mark applications and registrations, are maintained on the web-site (“On-line registers” section, http://www.fips.ru).

In order to ensure the effective access to comprehensive, reliable and actual information about registered trademarks and service marks, appellations of origin, well-known trademarks the electronic State Register of Trademarks and Service Marks of the Russian Federation, the electronic State Register of Appellations of Origin of the Russian Federation and the electronic List of Well-Known Marks of the Russian Federation (hereinafter referred to as ESR) and the automated system, ensuring its maintenance (hereinafter referred to as AS “ESR”) were developed in the period under review.

The basic decisions applied while developing ESR and AS “ESR” are the following:

  • basis of ensuring of reliable AS “ESR functioning is provided by the fault tolerance of the server architecture and of the storage system, it is achieved by deployment of redundant memory modules, power units, net interfaces, processors and hard drives. At the same time, the main software is allocated on the fail-safe RAID arrays. Fail-safety of ESR is achieved by applying the Centera storage system, which basically provides for the duplication of all the hardware components. These fail safe server architecture and storage system ensures the twenty-four hours functioning of AS “ESR” and ESR with allowed interruptions for preventive maintenance and reconfiguration in accordance with the schedule of regular maintenance not more than 104 hours per year. Moreover, the Centera storage system guarantees constancy of loaded data pending the specified storage period regardless to the right to access. In the case of violation of ESR integrity resulted from the complete failure of the hardware, catastrophe or other reasons the data recovery is provided from backup copies on the belt carriers by means of the corporative Networker system used in FGU FIPS;

  • the ESR entry is made at the moment of taking the decision on execution of legal action when working with the corresponding document processing system.

At the same time the ESR entry is signed by means of the electronic-digital signature of the executor. The improved electronic-digital signature is used for this purpose, it allows identifying the signatory and confirming his authorities at the moment of signature:

  • the data entered to the ESR are transmitted for publication on the portal of Rospatent within 5 minutes. The ESR content is accessible to the interested persons via this portal;

  • the ESR entries are stored in XML files in accordance with the recommendations of WIPO Standard ST.66. This provides the opportunity of automatic data processing, e.g. for interoffice electronic communications. In order to display the ESR content the XSL transformation is used.

External Internet Portal of Rospatent

During 2008 the external Internet portal of FGU FIPS has been developed and put into operation. The portal was built under the IBM WebSphere Portal software.

In order to perform proper testing, detect and eliminate imperfections (in particular following the users’ responses) during the first quarter of 2009 the FGU FIPS web-site (including information and search system) and recently implemented portal of FGU FIPS (including information and search system under new software) are maintained at the same time. At the end of the first quarter of the year it is planned to move completely to the portal realization of representation of Rospatent and FGU FIPS in the worldwide web.

Along with the traditional functions of the Internet site, Internet portal is a platform for development and deployment of a number of vitally important automated sub-systems, intended to improve the functioning of all services of Rospatent and FGU FIPS, in particular as:

  • platform for execution of continuous publication of official information on industrial property objects — inventions, utility models, industrial designs, trademarks, etc., using XML formats and technology;

  • platform for access to electronic State Registers on industrial property objects equipped by the possibility to check the electronic-digital signature (EDS);

  • platform for integrated representation, integrated data visualization system with the opportunity of personification of the content provided to the end-user;

  • platform for changes of methods and technology of filling the portal with information, allowing in the perspective the publication in real time with direct participation of FGU FIPS divisions.

PatSearch Information and Search System for inventions and utility models examination

During 2008 the most important step in development of the system was completed, namely downloading and indexing of the main searching arrays of patent documentation of countries of the PCT minimum. The basic array of extended abstracts and bibliographic data of  Dervent Co (Thompson Reuter) DWPI was downloaded as well 37 billion of documents. This array is the basic source of the search indexes. The arrays of patent documentation of the PCT, the EPO, the USA, Germany, England, France, English-language abstracts and facsimile copies of Japanese documents were downloaded. In total, there are more than 20 billion of patent documents in original language. Looking through the full descriptions of patent documents, which are not yet downloaded into the system, but found by the DWPI index, is provided for by the incorporated on-line query to the EPO arrays. The major part of the arrays is represented by facsimile images of patent descriptions and required huge memory volume for their deployment – several tens of TB. Simultaneously, the task of ensuring the required efficiency (up to 1000 users) and performance (5–10 seconds for standard search) on the full array of documentation was resolved. With this respect the server equipment, processor modules, data repositories, commutation equipment were purchased and the regular scheme of production calculating infrastructure was configured. During the exploitation this infrastructure will be optimized. Another important function of ISS is the possibility to use the automated translation of selected documents from foreign languages with the opportunity to add the specialized dictionaries. The system also provides the possibility to control the quality of work of the examiner while carrying out of the information search.

In order to ensure the efficient implementation of the system to practice the two-stage training course for examiners on PatSearch, consisting of “Basic training” course and “Extended course” has been developed and is widely used.

4.2. Exploitation of Internet Resources of Rospatent (2008)

During 2008 the access to the following resources was provided on the Internet-site of Rospatent:

  • Information search system (ISS) of patent documents of this country;

  • Registers of Russian patent documents of all the types of industrial property;

  • Register of trademark applications, filed in 2005–2008, complemented by the proceeding data on the applications filed in 2008;

  • Registers, containing information on processing the applications for patents, utility models and industrial designs filed in 2007–2008;

  • Official bulletins of Rospatent: “Inventions. Utility Models”, “Trademarks, Service Marks and Appellations of Origin”, “Industrial Designs”;

  • Daily published data on current registrations of trademarks, service marks, appellations of origin, well-known marks, and notifications on change of entries in the State Register of Trademarks before their publication in the Official Bulletin “Trademarks, Service Marks and Appellations of Origin”;

  • Official Bulletin of Rospatent “Computer Programs, Databases, Topographies of Integrated Circuits”.

The Internet Resources of Rospatent include the following databases:

  • a full text database of Russian inventions (containing information on 376 thousand patents for inventions, covering the period from 1994 up to 2008), updated three times per month;

  • a backdating database of Russian patent documents presented in facsimile format (containing information on 1, 433 thousand patent documents for inventions covering the period from 1924 up to 1993);

  • an abstract database of Russian inventions (containing information on 669 thousand applications and patents, covering the period from 1994 up to 2008), updated three times per month;

  • database of abstracts in English to Russian inventions (containing information on 375 thousand patents, covering the period from 1994 up to 2008), updated three times per month;

  • a full-text database of Russian utility models (containing information on 79 thousand Russian certificates and patents for utility models, covering the period from 1996 up to 2008), quarterly updated;

  • an abstract database of Russian utility models (containing information on 79 thousand certificates and patents for utility models, covering the period from 1996 up to 2008), updated three times per month;

  • a database of industrial designs (containing information on 32.5 thousand patents for industrial designs, covering the time period from 1993 up to 2008), monthly updated;

  • “Prospective inventions” database;

  • a database of Russian trademarks (containing information on 290 thousand Russian certificates for trademarks, covering the period from 1925 up to 2008), updated twice per month;

  • a database of International Trademarks Registrations with designation of Russia (containing information on 182 thousand international registrations with designation of Russia, covering the time period from 1980 up to 2008), weekly updated – the access is provided for subscribers to the Trademarks databases;

  • a database “Appellations of Origin” — the access is provided for subscribers to the Trademarks databases;

  • a database “Well-known Russian marks”;

  • a database of applications for inventions filed in 2007-2008 (containing information about examination procedure on 82 thousand applications), daily updated;

  • a database of applications for utility models filed in 2007–2008 (containing information about examination procedure on 21 thousand applications), daily updated;

  • a data base of applications for industrial designs filed in 2007–2008 (containing information about examination procedure of 9,5 thousand applications), daily updated

  • a database of Russian trademark applications filed during 2005-2008 (containing information about 157 thousand applications), daily updated;

  • International Patent Classification database;

  • International Classification of Goods and Services database;

  • International Classification of Industrial Designs database.

Access to and use of the Information and  Search System

Access for external users to the full text databases of inventions, as well as to databases of utility models, trademarks and industrial designs is provided on a contract basis.

Within the framework of the Program of Regional Cooperation between Rospatent and the Regions of the Russian Federation, 130 organizations obtained a free access to the full text databases of inventions.

18 passwords for free access to the trademark databases were provided to the agencies of the Federal Customs Service.

External users are provided with free access to the following products:

In respect of inventions:

  • Abstract databases in Russian and English;

  • “Prospective inventions” database;

  • Full text database containing documents published in three recent Bulletins “Inventions. Utility Models”;

  • IPC database,

In respect of utility models:

  • Full text database containing documents published in three recent Bulletins “Inventions. Utility Models”;

  • IPC database,

In respect of trademarks:

  • a database containing documents published in two recent Bulletins “Trademarks, Service Marks and Appellations of Origin”;

  • a database “Well-known Russian marks”;

  • International Classification of Goods and Services database.

During 2008 over 700 contracts providing access to commercially available databases of Rospatent were concluded. The total number of contracts concluded during the whole period of maintenance and use of the computerized system of Rospatent amounted approximately to 7100 contracts; by the end of 2008 about 5,200 contracts were still valid.

During 2008 the number of search queries submitted by internal and external users to the ISS totaled to 3,783 thousand, whereas:

  • Over 695 thousand – by internal users of the databases;

  • About 3088 thousand – by external users of the databases.

The number of search sessions performed in the search system during 2008 amounted to 871 thousand, whereas:

  • About 141 thousand – by commercial users

  • Over 604 thousand – on free of charge basis

  • Over 126 thousand – by Rospatent examiners

Access to and use of Registers of Russian patent documents

The users of Registers enjoyed a free access to all patent documents available in the Internet resources of Rospatent.

During 2008 the total number of queries submitted by internal and external users to the Registers exceeded 8,971 thousand, whereas:

  • Over 291 thousand were entered by the internal users of the databases;

  • Over 8680 thousand were entered by the external users of the databases.

Access to and use of Official Bulletins of Rospatent

Users enjoyed free access to the following bulletins of Rospatent published during the period of 2005–2008:

  • “Inventions. Utility Models”;

  • “Trademarks. Service Marks. Appellations of Origin”;

  • “Industrial Designs”;

  • “Computer programs, Databases. Topographies of Integrated Circuits.

In 2008 the total number of queries to electronic bulletins of Rospatent exceeded 237 thousand.

4.3. Use of Databases on Inventions, Utility Models and Scientific and Non-Patent Scientific and Technical Information for the Purposes of Examination of Inventions and Utility Models

In 2008 the range of documents in the examination collection on optical discs was extended by the databases of the EPO, WIPO, OAPI, EAPO, the Russian Federation, the CIS countries, Globalpat database, PAJ and a number of subject databases. In the 4-th quarter of 2008 the examination collection consisted of 99 databases, stored on 9310 CD-ROMs and DVD-ROMs, containing information on 22 countries and 4 international organizations.

In December 2008 all databases on optical discs were transmitted to the State Patent Collection from the examination collection. This step was preceded by a comprehensive analysis of use of databases on various mediums by examiners during performing search. The received statistic results showed that at present in majority of cases the examiners use on-line databases at their working places.

Table 4.3.1 reflects use of collection on optical discs by examiners; it shows the decrease of the number of discs in the collection and the number of access by the examiners during search. The total number of discs, provided to examiners for search in 2008 decreased to 9 pieces, and all of them were demanded in the first quarter of 2008.

Examiners who performed search in the CDROM room (505 persons), worked generally with the on-line databases or searching engines in the Internet, but not with the optical mediums

When the information accessible to the examiners at their working places was insufficient, they used both commercial databases (Russian and foreign) inaccessible from their working stations and unlimited Internet access.

Examiners used the CDROM room generally in order to search for scientific-technical literature on library’s web-sites, special and subject databases, and in search Internet-engines Google, Rambler, Yandex etc. as well.

The frequency of addresses to various databases in the CDROM Room is shown in Table 4.3.2

System of automated text translation

During 2008 the PROMT system of automated translation was updated, it is used when analyzing selected documents or using e-mail and foreign Internet-sites. At present examiners use version 7.0 of PROMT Professional. Additional working stations equipped with the PROMT system of automated text translation, purchased in 2008, provide possibility to use the system by all examiners and more than 100 other employees of Rospatent, having access to this translation system.

Training on computer search

The CDROM Room in FGU FIPS is also used as a facility for staff training on computer search in various available automated and search systems.

During 2008 trainings on various topics were regularly carried out aimed at the professional training of FGU FIPS employees and increasing quality of their work. Following the implementation of the patent search system PatSearch all examiners (more than 500 persons) participated in the training devoted to the basis of its use.

Moreover, training for examiners on use of electronic databases, selected for information search during examination was carried out.

126 examiners participated in the training on use of Asian databases freely accessible via the Internet (Japan, Korea, China and Taiwan).

Other area of training concerned to the issues of using the electronic document processing systems and special applications. Training took place following the development of new automated systems, purchase of selected databases, on the results of the investigations of information resources in the Internet, as well as on the existing and updated software (upon request of FGU FIPS personnel).

Annual training for new examiners in 2008 was devoted to work with the most frequently used databases and automated systems.

4.4. Use of Databases for Online Search During Examination of Inventions and Utility Models

For carrying out information searches for the purposes of the examination of applications the examiners of FGU FIPS have been making use mainly of electronic databases accessible online.

First of all, these are the online freely accessible databases of the Patent Offices and some databases containing non-patent documentation, where the examiners could search from their working stations. In 2008 the list of these databases was extended by the databases of Armenia and Estonia.

The most frequently used databases freely available via the Internet are the databases of Rospatent, the EPO (esp@cenet), the USPTO, JPO, German Patent Office (Depatisnet), WIPO and the internal system of the Eurasian Patent Office, EAPATIS.

During 2008 in examination divisions of FGU FIPS testing the PatSearch internal search system of Rospatent was continued with restricted bulk of information, including all documents of the former USSR and Russia, patent documents of the CIS countries and bibliographical data and abstracts of patent documents of developed countries, downloaded form the GlobalPat discs.

From the number of freely accessible DBs of non-patent literature, the examiners most frequently use from their working stations the databases on medicine and pharmacy of the USA National Library and multidisciplinary DB Science Direct. The examiners widely use freely available dictionaries and translation applications.

Along with DBs freely available for performing search on applications, the FGU FIPS examiners can perform complicated searchers in commercially available DBs. In particular:

  • databases available via the STN International network, covering both patent and non-patent literature. The most frequently used databases belong to the area of chemistry (REGISTRY, CA, BEILSTEIN, CASREACT, CHEMCATS and other), medicine (EMBASE, BIOSIS), as well as polytechnic DBs (INSPEC, PASCAL, COMPENDEX),

  • Patent Databases of Thomson Innovation. In addition to the databases of major world Patent Offices and INPADOC database, Thomson Innovation provides the FGU FIPS examiners with access to the abstract DB WPI (World Patent Index) and the abstract collection of scientific and technical literature (DB Web of Science, Current Contents Connect, and ISI Proceedings). Access to the Thomson Innovation DB is provided for 3 working stations.

  • DB of patent documents of Japan in English PATOLIS-e owned by Questel company.

Access for examiners to commercially available remote databases was provided in two specially equipped Rooms (for 4 and 10 working stations respectively) where the examiners could receive needed consulting and methodological assistance from a qualified staff while performing searches. Remote databases available in the Online Access Room are usually searched by examiners in complicated cases, where a wider range of information resources are required for the purposes of searches but not accessible from the examiner’s working stations or the qualification of an examiner is not sufficient for making searches in a particular database.

During 2008 only in one of two Remote Access Rooms over 750 such complicated searches were conducted in the chemistry area. The majority of searches were performed in the STN databases in the sphere of chemistry. Vast majority of them were performed in the STN-network databases, namely CA (Chemical Abstracts) and REGISTRY.

The personnel providing services in the Remote Access Room are also engaged in investigating and reviewing other online databases, which could be useful for the purposes of information searches and prepare Methodological Guidelines and Manuals for examiners how to use new databases. In 2008 in order to support substantial examination the BLAST program, which is used for search in DBs of amino acid and nucleotide sequences was analyzed and described.

Moreover, the personnel of the Remote Access Room are involved in training and providing consultations to the examiners on using available DBs.
