4.1. Program for Complex Modernization of Automated Systems

Within the framework of implementation of the Program for Complex Modernization of Automated Systems of Rospatent in 2009 the following activities took place:

  • the works were carried out in order to ensure reflection of the amendments of the legislation under the Administrative Regulations on the Fulfillment of the State Functions in a course of updating Rospatent’ automated systems such as ABD, ТM RU, Contracts, ESR;
  • automated system система providing service for the system of the electronic State Register of Trademarks and Service Marks and electronic State Register of Appellations of Origin and the electronic List of Well-known Marks of the Russian Federation (AS “ESR”) developed in 2008 has been put into regular operation. Since September 2009, the data concerning registration are entering to AS “ESR” only. In order to ensure the effective access to the data stores AS “ESR”, it was connected to the document processing system of Rospatent. Each entry is signed by electronic digital signature of the officer, which allows identifying the person signed the document and controls its authorization at the moment of signing. Inputting of the entries to AS “ESR” takes place simultaneously with the entries to the State Register Books made before September 15 2009 г.;
  • information search system for examination of inventions and utility models PatSearch has been put into testing operation for all the working stations of patent examiners;
  • within the limits of performance of works on development of the automated librarian technological processes on the basis of a program complex «A-Elite», the technology of express delivery of the literature for use in the reading room mode was introduced, allowing to carry out literature delivery by a principle «stroke-code of the publication» — «stroke-code of the reader». Implementation of the new mechanism of communication has provided an access of the Patent Library (VPTB) to more than to 40 databases of 11 central libraries (Russian State Library, Library of the Russian Academy of Sciences, State Public Scientific Technical Library, Library of the Moscow State University, etc.), carrying out services within the framework of interlibrary subscription under the protocol z.39.50. Activity of the Department of Collection for the State Patent Examination, taking into account the specificity of work of department, was automated. Works on converting, re-cataloging of the information arrays of the databases «Scientific and Technical Literature» and «Periodicals» - in total amount of 60 thousand records - are finished. The new classification scheme with use of IPC-8 (enlarged version) is created;
  • the most important component of the uniform system of fees calculation (IES «Fees») providing for the electronic payment documents from the State Treasury of Russia related to objects of a patent right: inventions, utility models and industrial designs is developed and put in operation. IES «Fees» provides the opportunity to link the extract from Russian Treasury and legally significant actions, for which these assets are accounted for, allows tracing in dynamics of a stage of processing of payment documents. For achievement the above results, the system of document processing of the objects of patent rights and IES «Fees» were integrated. At present, the system IES «Fees» allows to account of the fees for fulfillment of legal actions according to requests for registration of contracts, requests for amendments of trademark registrations, requests for fulfillment of legal actions related to examination of applications for the inventions, utility models, industrial designs and payment of patent maintenance fees;
  • automated system of electronic filing of applications for trademark registration and electronic interaction with the applicants is developed and put in testing operation. The system is intended for possessing electronic documents exchange between the applicant and the office, including materials of the applications as originally filed using electronic digital signature (EDS) and integrated into the hardware and software environment of the automated system of trademark paperless document processing “TM-ADMIN”. The system functions are as follows: preparation and check of the documents and data of trademark application (including materials of the application as originally filed), drafting the list of goods and services according to the Nice Classification (Edition 9), signing of a package of the documents by mean of EDS and sending thereof to the office, receiving documents of examination from the office, servicing the user “cabinet”, etc. During system development the problems of safe interaction of the web applications with the local internal network of FGU FIPS were solved, as well as the problem of synchronization of data in the user cabinet and database TM-ADMIN and problem of quality control of information at data input and registration of the trademark application were settled. The use of the system is focused on processing of electronic documents, assumes decreasing terms of examination and cost of examination;
  • global upgrading of hardware and software platform of the automated systems of the document processing of inventions, utility models and industrial designs and transferring of the above systems from computer RM-600 to Prime Power 1500, Fujitsu Siemens, working under control of OS SOLARIS were fulfilled. This work has allowed considerably raising the stability of work of the automated systems ABD, Electronic Archive of Applications and Electronic Library of the РСТ applications. The number of users of the systems has increased from 600 to 800 persons; a real possibility of systems scaling, including use of the elements of electronic document exchange, was achieved;
  • system of electronic filing of applications for inventions is developed. In 2010 this system will be put in testing operation.

PatSearch Information and Search System for Inventions and Utility Models Examination

In 2009 PatSearch Information and Search System for Inventions and Utility Models Examination (ISS) was input in testing operation for all the working stations of the Rospatent’ patent examiners. PatSearch System was developed as a professional information and search system for inventions and utility models examination. That is why this system has a wide set of functional and servicing possibilities.

In 2009 the downloading and indexing of the main searching arrays of patent documentation of countries of the PCT minimum was completed. The basic array of extended abstracts and bibliographic data of Dervent Co. (Thompson Reuter) DWPI was downloaded (40 million of documents). This array is the basic source of the search indexes. The arrays of patent documentation of the former USSR, Russia, the PCT, the EPO, the USA, Germany, England, France, Austria, Australia, English-language abstracts and facsimile copies of Japanese documents were downloaded. In total, there are more than 20 billion of patent documents in original language. Looking through of the full descriptions of patent documents, which are not yet downloaded into the system, but found by the DWPI index, is provided for by the incorporated on-line query to the EPO arrays. The search for non-patent literature is realized by integrated request to the external digital library (E-Library).

The major part of the arrays is represented by facsimile images of patent descriptions and required huge memory volume for their deployment – several tens of TB. Simultaneously, the task of ensuring required efficiency (up to 1000 users) and performance (5–10 seconds for standard search) on the full array of documentation was resolved. With this respect the server equipment, processor modules, data repositories, commutation equipment were purchased and the regular scheme of production calculating infrastructure was configured. Another important function of ISS is the possibility to use the automated translation of selected documents from foreign languages with the opportunity to add the specialized dictionaries. The system also provides the possibility to control the quality of work of the examiner while carrying out of the information search.

In order to ensure the efficient implementation of the system to practice the two-stage training course for examiners on PatSearch, consisting of “Basic training” course and “Extended course” has been developed and is widely used.

4.2. Realization of the Program of Complex Modernization of the Computer Network of Rospatent in 2009

In 2009, within the limits of realization of the Program of complex modernization of the computer network of Rospatent, the following works have been performed.

Modernization and Development of a Network Infrastructure with Splitting of a Network on Virtual Subnet VLAN

The purpose of modernization was to decrease of loading of a network by the office traffic, increase of general reliability of functioning and scalability of computer network of FGU FIPS. As a result of performance of this activity, the computer network of FGU FIPS has been divided into the segments. Each administrative division (department) as well as a server pool received a separate segment (separate domain) according to Fig. 4. Thus the work of all applications available in FGU FIPS has been provided for.

Modernization has been implemented at the expense of installation of new switching equipment (45 new switchboards have been established). The changes of the configuration of existing active network equipment, servers and computers of users have been also fulfiled. The software has been upgraded in a part of the switching equipment

Development and Implementation of the Integrated System for Monitoring and Management of the IT Infrastructure of FGU FIPS (ISMM) on the Basis of Products IBM Tivoli

The purpose of development of the integrated system for monitoring and management of the IT Infrastructure of FGU FIPS on the basis of products IBM Tivoli was providing for due level of functioning of the computing environment of FGU FIPS and increase of a management efficiency by means of IT Resources.

Information resources of FGU FIPS include dozens of the servers located in various premises of FGU FIPS All these servers are connected by software and failures in work of one server lead to failures in work of all technological sites.

Implementation of the complex system of monitoring and management of the IT Infrastructure has led to:

  • increase of reliability of work of the equipment and software at the expense of timely revealing of negative tendencies and acceptance of preventive measures on restoration of working capacity of the equipment and software;
  • reduction of idle time of objects of information systems FGU FIPS in connection with refusals of the equipment and software errors;
  • decrease in idle times of an information infrastructure;
  • providing for the means of optimization of use of available resources;
  • decrease in time necessary for implementation of new technologies;
  • increase in general controllability of the information environment;
  • decrease in requirements to quantity of the personnel responsible for operation of ISMM FGY FIPS;
  • Preventive maintenance and minimization of probability of occurrence of supernumerary situations;
  • decrease in operational costs on an information technology and related technologies;
  • fast restoration of the data and systems after failures.

The platform IBM eServer BladeCenter was chosen for hardware maintenance of ISMM FGY FIPS.

Development and Implementation of the Complex System of Information Security of FGY FIPS

The purpose of development complex system of information safety is providing for the protection of data processed by the automated system of data processing of FGY FIPS (АSDP) on applied and net levels.

The complex system of information safety (CSIS) meets the following requirements:

  • integration of components among themselves and with existing means of information safety (gateway screens, systems of detection of attacks);
  • prevention or essential difficulty of plunder, distortion or a fake of the information processed within the limits of АSDP FGY FIPS;
  • confidentiality and integrity of the processed information when keeping comprehensible level of availability.

CSIS takes into account the imperative norms regulating the personal data safety order, established by the Federal law (July 27, 2006 № 152-FZ) «On the Personal Data», Resolution of the Government of the Russian Federation (November 17, 2007 № 781) «On Adoption of the Statute for Safety of the Personal Data at Processing thereof in Information Systems of the Personal Data» and other normative acts of the Russian Authorities.

CSIS consists of the following subsystems:

  • Subsystems of detection of computer attacks at applied level;
  • Subsystems of the analysis of security;
  • Subsystems of management of sensors of attacks and the security analysis;
  • Subsystems of management of incidents in information safety;
  • Subsystems of management of accounting records and access;
  • Subsystems of interaction with the Internet.

Development of the Uniform Storehouse of Databases Oracle and Documentum on the Basis of Disk Subsystems NetApp

The purpose of creation of the uniform storehouse was working out of the hardware and software complex intended for storage of databases Oracle and Documentum with reserve archiving of following subsystems:

  • PatSearch
  • Tm-Admin

Basically, the servers of FGU FIPS are placed in two Data Processing Centers (DPC), first of which (basic) is located in a premises at the address: Berezhkovskayia nab. 30-1, and the second (reserve) is located in a premises at the address: Berezhkovskayia nab. 24-12.

They are connected by optical channels having a pass-band equal to 10000 Mbit/s (10 Gigabit/s).

Servers of applications for PatSearch and Tm-Admin are placed in the main DPC.

Applications Data are stored in Data Storage System (DSS) on disk system NetApp 6070.

Volumes of databases Oracle of both applications are connected to servers under technology Fibre Channel (FC) and NFS.

Volumes of Documentum of the applications are connected to servers by means of technology CIFS.

There is one more DSS NetApp 6080 in reserve DPC.

At present, the reserve copying is made with the assistance of software Legato NetWorker to the library Scalar 1000 placed in basic DPC.

In reserve DPC the Library Scalar 2000 (using for data archiving) is established.

As a result of the works the following has been provided:

  • Reliable archiving of data of subsystem Oracle and Documentum;
  • Data uniformity;
  • Possibility of fast and reliable restoration of data in case of failures of data storage system and errors of the managers.

Implementation of the System for Monitoring and Management of Engineering Infrastructure of Computer Network on the Basis of Software DESIGO

The implementation of the system provides for the visual control and management from a uniform control unit of following subsystems:

  • Ventilation subsystems;
  • Air-conditioning subsystems;
  • Subsystems of the fire alarm and fire extinguishing;
  • Subsystems of an electrical supply and management of sources of an uninterrupted power supply (UPS);
  • Subsystems of the control of access to server rooms.

4.3. Use of the Internet Resources of Rospatent

During 2009 the access to the following resources was provided on the Internet-site of Rospatent:

  • Information search system (ISS) of patent documents of this country;
  • Registers of Russian patent documents of all the types of industrial property;
  • Register of trademark applications, filed in 2005–2009, complemented by the proceeding data on the applications filed from 2008 to 2009;
  • Registers, containing information on processing the applications for patents, utility models and industrial designs filed from 2007 to 2009;

Official bulletins of Rospatent:

  • “Inventions. Utility Models”;
  • “Trademarks, Service Marks and Appellations of Origin”;
  • “Industrial Designs”;

Daily published data on current registrations of trademarks, service marks, appellations of origin, well-known marks, and notifications on change of entries in the State Register of Trademarks before their publication in the Official Bulletin “Trademarks, Service Marks and Appellations of Origin”;

Official Bulletin of Rospatent “Computer Programs, Databases, Topographies of Integrated Circuits”.

The Internet Resources of Rospatent include the following databases (DB):

  • full text DB of Russian inventions (containing information on 387 thousand patents for inventions, covering the period from 1994 up to 2009, updated three times per month);
  • backdating DB of Russian patent documents presented in facsimile format (containing information on 1433 thousand patent documents for inventions covering the period from 1924 up to 1993);
  • abstract DB of Russian inventions (containing information on 402 thousand applications and patents, covering the period from 1994 up to 2009, updated three times per month);
  • DB of published applications for inventions (containing information on 326 thousand applications for inventions, covering the period from 1994 up to 2009, updated three times per month);
  • DB of abstracts in English to Russian inventions (containing information on 410 thousand patents, covering the period from 1994 up to 2009, updated three times per month);
  • a full-text DB of Russian utility models (containing information on 90 thousand Russian certificates and patents for utility models, covering the period from 1996 up to 2009, quarterly updated);
  • abstract DB of Russian utility models (containing information on 90 thousand certificates and patents for utility models, covering the period from 1996 up to 2009, updated three times per month);
  • DB of Russian trademarks (containing information on 322 thousand Russian certificates for trademarks, covering the period from 1925 up to 2009, updated twice per month);
  • DB of International Trademarks Registrations with designation of the Russian Federation (containing information on 197 thousand international registrations with designation of Russia, covering the time period from 1980 up to 2009, weekly updated) – the access is provided for subscribers to the Trademarks databases;

Access to and use of the Information and Search System

Access for external users to the full text DB of inventions, utility models, trademarks and industrial designs is provided on a contract basis.

Within the framework of the Program of Regional Cooperation between Rospatent and the Regions of the Russian Federation, 130 organizations received a free access to the full text databases of inventions.

18 passwords for free access to the trademark databases were provided to the agencies of the Federal Customs Service.

Within the framework of the Agreement on Cooperation of Rospatent with certain organizations, a free access was provided to:

  • full text DB of inventions — 40 organizations participating in the State Project on development of nanotechnologies;
  • all the DBs of FGY FIPS - 83 organizations of the Federal Service of Bailiffs.

External users are provided with free access to the following products:

In respect of inventions:

  • Abstract DBs in Russian and English;
  • DB of published applications for inventions;
  • DB “Prospective inventions;
  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB,

In respect of utility models:

  • Full text DB containing documents published in three recent Bulletins “Inventions. Utility Models”;
  • IPC DB;

In respect of trademarks:

  • DB containing documents published in two recent Bulletins “Trademarks, Service Marks and Appellations of Origin”;
  • International Classification of Goods and Services DB.

During 2009 over 610 contracts providing access to commercially available databases of Rospatent were concluded. The total number of contracts concluded during the whole period of maintenance and use of the computerized system of Rospatent amounted approximately to 7700 contracts; by the end of 2009 about 5800 contracts were still valid.

During 2009 the number of search queries submitted by internal and external users to the ISS totaled to 4536 thousand, whereas:

  • Over 689 thousand – by internal users of the databases;
  • About 3847 thousand – by external users of the databases.
  • The number of search sessions performed in the search system during 2009 amounted to 960 thousand, whereas:
  • About 179 thousand – by commercial users
  • Over 660 thousand – on free of charge basis
  • Over 125 thousand – by Rospatent examiners

Diagram 1 shows the distribution of numbers of queries processed by the ISS during the period of 2002–2009.

Diagram 2 shows the distribution of numbers of queries processed by the ISS by intellectual property titles.

Access to and use of Registers of Russian patent documents

The users of Registers enjoyed a free access to all patent documents available in the Internet resources of Rospatent.

During 2009 the total number of queries submitted by internal and external users to the Registers exceeded 12880 thousand, whereas:

  • Over 257 thousand were entered by the internal users of the databases;
  • Over 12623 thousand were entered by the external users of the databases.

Diagram 3 shows the distribution of queries to Registers by years.

Diagram 4 shows the distribution of queries to registers broken down by industrial property titles.

Access to and use of Official Bulletins of Rospatent

Users enjoyed free access to the following Bulletins of Rospatent :

  • “Inventions. Utility Models” (three last published Bulletins);
  • “Trademarks. Service Marks. Appellations of Origin” (two last published Bulletins);
  • “Industrial Designs” (last published Bulletin) ;
  • “Computer programs, Databases. Topographies of Integrated Circuits (last published Bulletin).

In 2009 the total number of queries to electronic bulletins of Rospatent exceeded 1024 thousand.

4.4. Use of Databases for the Purposes of Examination of Inventions and Utility Models

In 2009 the information search carried out from the individual working stations of the patent examiners allowed to carry out multidimensional search in national and foreign patent information (РСТ minimum documentation) completely in electronic environment.

PatSearch, the internal search system of Rospatent, which new version has been put in operation in 2009, becomes the basic instrument for carrying out searches.

The system is available on all the working stations of patent examiners (about 600).

Arrays of patent documents of Russia and the former-USSR, patent documentation of the CIS countries, DB WPI and arrays of the foreign documents (РСТ minimum documentation) now are included in the system structure. Besides, the system PatSearch allows to carry out not-patent literature search by using web-site of the Scientific Electronic Library (eLIBRARY.RU), containing more than 28 thousand titles of periodicals, including more than 5700 in Russian.

Implementation of interdepartmental system of patent search PatSearch in practice has dictated necessity of training of all the patent examiners as to functions and search possibilities of this system. The most part of the examiners have already passed such training and successfully mastered carrying out of search in system PatSearch, allowing formulate the difficult inquiries in patent documentation of Russia, the CIS countries, the EPO, WIPO, the countries of РСТ minimum documentation as well as DB DWPI.

4.5. Use of Databases on Inventions, Utility Models and Non-Patent Scientific and Technical Information for the Purposes of Examination of Inventions and Utility Models

The patent examiners for carrying out of searches in scientific and technical literature and certain patent documents are using local databases available in a «Training and Computer Search» Room. This Room contains the collection specialized and subject-matter DB on optical disks. Free access by Internet to websites of different libraries and use of search system (Google, Rambler, Yandex) is also available in this room.

The patent documentation on optical disks is not often used when carrying out searches by patent examiners and in special cases only it is used for carrying out for research, analytic, reclassification and other purposes.

Frequency of addresses to DBs accessible in «Training and computer search» Room is shown in Table 4.5.1.

The above scheme shows that, as a rule, the patent examiners address to DB VINITI containing abstracts of the huge number of articles from non-patent literature, including periodic and books.

In 2009 training of the patent examiners for improvement of professional skills in various fields was continued that has provided for due quality of the works.

Training of experts as to electronic databases and automated systems for carrying out of information searches in the course of examination, as well as training related to new automated systems, results of researches in information resources of the Internet and current and advanced software was organized.

In 2009 the annual training as to DBs, which are most frequently used for patent search, was continued.

The main topics of training during 2009 in «Training and computer search» Room are shown in Table 4.5.2.

All kinds of the training were organized under the special programs, taking into consideration the categories of the trainees, that allows to effective use of software products.

In 2009 the works on practical implementation by patent examiners of the machine translation system of texts PROMT (version of PROMT Professional 7.0) have been continued. The ways of creation of additional specialized dictionaries and possibility of integration thereof into the system PROMT have been investigated. Functionality of version 8.5 of the system PROMT, possibility of purchasing and updating it by accessible, used from the working stations by the examiners and the employees of other departments when working with information available via websites and e-mail communications were investigated. The frequency of the use of machine translation system from the working stations at the request of the employees has increased.

4.6. Use of Databases for On-line Search During Examination of Inventions and Utility Models

At present, for carrying out of information searches for the purposes of the examination of applications, the examiners of FGU FIPS have been making use mainly of electronic databases accessible online.

If for any reasons the search in interdepartmental search system PatSearch is not enough for patent examiner, an additional patent information are usually received from the DB, freely accessible via Internet, for example: Esp@cenet, DBs of the USPTO, JPO, WIPO, search system of the Eurasian Patent Office (EAPATIS).

For data acquisition from the applications of the JPO and KIPO (under the program of the Patent Prosecution Highway, РРН) in 2009 the examiners of the FGU FIPS had received an access to DBs AIPN and K-PION.

From the number of freely accessible DBs of non-patent literature, the examiners most frequently use from the working stations the databases on medicine and pharmacy of the USA National Library (PubMed) and multidisciplinary DB Science Direct.

Along with DBs freely available for performing search on applications, the FGU FIPS examiners can perform complicated searchers in commercially available DBs.

In particular:

  • databases available via the STN International network, covering both patent and non-patent literature. The most frequently used databases belong to the area of chemistry (REGISTRY, CA, BEILSTEIN, CASREACT, CHEMCATS and other), medicine (EMBASE, BIOSIS),
  • Search System of Thomson Innovation. In addition to the databases of major world Patent Offices and INPADOC database, in 2009 the examiners of FGU FIPS examiners had access to the abstract DB WPI (World Patent Index) and the abstract collection of scientific and technical literature (DB Web of Science, Current Contents Connect, and ISI Proceedings). Access to the Thomson Innovation DB is provided for 3 working stations.
  • DB of patent documents of Japan in English PATOLIS-e owned by Questel company.

Access for examiners to commercially available remote databases is available in specially equipped Online Access Room , where the examiners could receive consulting and methodological assistance from a qualified staff while performing searches. Remote databases available in the are usually searched by examiners in complicated cases, namely where a wider range of information resources are required for the purposes of searches but not accessible from the examiner’s working stations or the qualification of an examiner is not sufficient for making searches in a particular database.

During 2009 in the Remote Access Rooms over 1300 complicated searches were conducted. The majority of searches were performed in the STN databases in the sphere of chemistry. Vast majority of them were performed in the STN-network databases, namely REGISTRY and CA .

Increase of qualification of the examiners in carrying out the searches by training of experts to use of accessible DB, first of all, search system of Rospatent (PatSearch) is permanently organized.

For the purpose of improvement of information support of the examination, the available on-line DBs which can be useful to carrying out of information searches are constantly studied and methodical guidance for examiners are prepared.
